Mr. <br /> 5 Peterson confirmed that the contractor did prepare the site plan. He explained that an individual <br /> 6 by the name of Greg,who is responsible for checking the plans, stated that they would need the <br /> 7 variance. <br /> 8 <br /> 9 Chair Stromgren asked if they had a survey to go by, did they find the corner monuments or did <br /> 10 they measure from the back of the curb. Mr. Peterson explained that they went based on the <br /> 11 description of the lot. <br /> 12 <br /> 13 Commissioner Tillman asked.City Manager Momson if the setback is from the easement line or <br /> 14 from the curb. City Manager Morrison clarified that the setback is from the property line. <br /> 15 Commissioner Tillman asked if the property line is on the curb or in from the curb. City <br /> 16 Manager Morrison stated that it is usually in from the curb. <br /> 17 <br /> 18 Commissioner Tillman stated that it is her understanding that it really doesn't matter what is the <br /> 19 front or the.side of the house because a front yard is a 30-yard setback and a side yard on a street <br /> 20 is a 30-yard setback. City Manager Morrison confirmed that this is correct. <br /> 21 <br /> 22 City Manager Morrison further explained that the Building Inspector interpreted the <br /> 23 recommendation this way because had he called it a front yard setback Mr. Peterson would have <br /> 24 automatically been out of compliance with the backyard setback requirements. He explained that <br /> 25 they give the Building Inspector some latitude with interpretation on a corner lot with regards to <br /> 26 what is the front and the side of a house. He further explained that they also tell the Building <br /> 27 Inspectors to interpret it to the benefit that makes the most sense from a setback point of view. <br /> 28 He stated that the houses along Wilson are fairly even noting that the houses along 31"are not. <br /> 29 He stated that either way Mr. Peterson would need a letter for the variance. He indicated that Mr. <br /> 30 Peterson came in last fall and applied for the building permit noting that he only came forward <br /> 31 this past month expressing his interest to move forward with the variance request. <br /> 32 <br /> 33 City Manager Morrison explained, for the benefit of the new Commissioners,that the purpose of <br /> 34 the Concept Review is an informal discussion between the applicants and the Commission and <br /> 35 then proceeds on to the public hearing next month. He stated that this also provides an avenue to <br /> 36 get the issues out in the open for something the Commission might want the applicants to <br /> 37 research further. <br /> 38 <br /> 39 Commissioner Young asked Mr. Peterson if he had considered placing the addition along the east <br /> 40 side of the house. Mr. Peterson stated that this is his backyard area adding that he does not want <br /> 41 to have the sunroom along that side of the house. He explained that sun normally comes from <br /> 42the south side of the house. He stated that they are looking for a quiet place to sit in the evenings. <br /> 43 He noted that if they were to place it along the back they would have to access through the <br /> 44 garage, which is another reason for not placing it there. He explained that his wife has asthma <br />
