2. Rice Creek Watershed District <br /> <br />Comment 1: <br />As noted, the project will require review and permitting under RCWD Rule D (Erosion <br />Control Plans). Based on our understanding of the project, no other RCWD Rules will <br />apply to this project, provided that DNR maintains jurisdiction over the Public Water <br />Wetland onsite and does not waive its jurisdiction to the RCWD, as LGU for Minnesota’s <br />Wetland Conservation Act. <br /> <br />Response 1: <br />Thank you for your comment. We anticipate requiring permitting with the RCWD <br />under Erosion Control, Rule D. <br /> <br />Comment 2: <br />The RCWD encourages the City to explore options for the removal of phosphorus from <br />the water within Mirror Lake prior to it being sent downstream during the dewatering <br />phase of this project. As the City is well aware, Mirror Lake contains some of the highest <br />concentrations of phosphorus of any waterbody within our watershed. Simply releasing <br />that massive load of phosphorus downstream, unchecked, would seem to undermine <br />many of the water quality gains we hope to achieve with this project and others, such as <br />the Hansen Park project located downstream of this site. The RCWD offers its support <br />and partnership to explore options for chemical or other treatment of the water in this <br />basin prior to discharge. <br /> <br /> Response 2: <br />The City of St. Anthony Village plans to have ongoing coordination with Rice <br />Creek Watershed District and is open to discuss feasible options to best achieve <br />the goals desired from this project. <br /> <br /> Comment 3: <br />The construction schedule of this project will very likely coincide directly with the <br />construction schedule for the RCWD’s Hansen Park project downstream in the City of <br />New Brighton. Both projects will involve the complete dewatering of their respective <br />wetland basins. As construction for both projects draws nearer, it will be vital for the <br />projects to be staged appropriately and for us to all work together to ensure that <br />dewatering activities at Mirror Lake do not negatively impact dewatering activities at <br />Hansen Park. In other words, it would be advantageous to dewater Mirror Lake first, so <br />that the increased flow and volume does not re-fill the basin in Hansen Park or mobilize <br />contaminated sediments that may be exposed within that basin once dewatering has <br />commenced. The RCWD expects to be an active partner with the City throughout the <br />Mirror Lake project and will take steps to ensure communication takes place as needed <br />on this matter. <br /> <br /> <br />41
