5. Sewer Availability Charges (SAC). Prior to the issuance of any certificate of <br />occupancy, Sewer Availability Charges (SAC) shall be satisfied, if applicable. <br />6. Licensing and Other Permits. All uses permitted and conditionally permitted <br />within the 2015 -01 PUD — Planned Unit Development Overlay Zoning District <br />shall comply with applicable licenses and other permits deemed necessary by <br />City, County, State or Federal or other applicable jurisdictions. <br />7. Breach of Conditions. If the Property Owner /Applicant breaches the conditions <br />of the PUD, the City Council shall provide the Property Owner /Applicant with a <br />written notice of the breach and an opportunity to be heard before the City <br />Council to respond to the alleged breach of the PUD Ordinance. If, after <br />providing the Property Owner /Applicant with notice and opportunity to be heard, <br />the City Council determines the Property Owner /Applicant has breached the PUD <br />Ordinance, the City Council may: <br />i. Treat the breach of the PUD Ordinance as a violation of the City's Zoning <br />Ordinance and pursue the remedies set forth in the Zoning Ordinance for <br />violations of the Zoning Ordinance; or <br />ii. Pursue any other right or remedy available at law or in equity. <br />If the City Council determines the breach of the PUD was unintentional, the City <br />Council may, but shall have no obligation to, provide the Property <br />Owner /Applicant with a reasonable period of time to cure the breach and suspend <br />the City's enforcement of its rights for such reasonable period of time. <br />H. 2015 -01 PUD — Planned Unit Development Overlay Zoning District Approval. This <br />2015 -01 PUD — Planned Unit Development Overlay Zoning District shall be created <br />upon City Council's approval of the Preliminary and Final PUD Plans and the Site <br />Plan for the Property located at 3055 Old Highway 8. <br />Section Two. Approval of the Preliminary and Final PUD Development Plan / Site Plan <br />The City Council of the City of Saint Anthony Village approves the Preliminary and Final PUD <br />Development Plans / Site Plan associated with the Property located at 3055 Old Highway 8 as <br />follows: <br />A. Approved Preliminary and Final PUD Development Plans/ Site Plan The subject <br />property shall continue in parking and building size, shape, and layout to existing <br />conditions. Any modifications to the use, location, placement size or height of <br />any buildings or parking shall require a revision to the 2015 -01 PUD — Planned <br />Unit Development Ordinance in accordance with City Code § 152.206. Any <br />modification in use or size of the 12,941 square foot area approved for Religious <br />Assembly use as depicted in the Development Plan attached as Exhibit B shall be <br />a significant change requiring an amendment to the 2015 -01 PUD — Planned Unit <br />Development Ordinance approved by the City Council. Any change in the <br />location of the 12,941 square foot area for Religious Assembly shall be a minor <br />change subject to approval by the Development Review Committee, provided that <br />the change in location remains subject to the 11,655 square-foot limitation on the <br />lower level and the 1,286 square -foot limitation on the main level. <br />B. Findings for Approval of the Preliminary and Final PUD Development Plans The <br />City Council finds that the Preliminary and Final PUD Plans / Site Plan are <br />consistent with the criteria for approval of the Preliminary and Final PUD <br />
