r <br /> r <br /> -2- <br /> A <br /> 2-A letter from Brauer and Associates Incorporated, was <br /> Houle Landscape Company's Contract. Mr. Houle's request to withdraw from <br /> the agreement was explained by Mr. Peret of Brauer and Associates Inc. <br /> Councilman Sorenson moved and seconded by Mayor O'Connor that the Houle contract <br /> be carried out as per agreement. <br /> Motion Carried. <br /> A public hearing on the proposed storm sewer improvement to drain surface watere <br /> from an area approximately 400 feet North of 35th Avenue N.E., between Stinson <br /> Boulevard and Roosevelt Street was called to order by the Mayor. DeWayne Olson, <br /> Village engineer, presented the drainage proposal in detail. He informed <br /> those present that the drainage area included eight properties as outlined <br /> and that the cost of the project was $1735.00 with an additional cost of <br /> engineering and legal fees. Mr. Bickman, 3525 Stinson Boulevard and Mr. Yates <br /> of 3520 Roosevelt Street stated that they felt their properties were not incl- <br /> uded in the drainage area. This was confirmed by Mr. Olson, Village engineer. <br /> Mr. Johnson stated that twelve properties were included in the 1959 drainage <br /> study. Mr. Olson informed him that a traverse of the area indicated eight <br /> properties. Mr. Haik, Village Attorney, informed those present that if a R/W <br /> had to be obtained, the condemnation costs would be part of the improvement <br /> • costs. Mr. Aggeson, 3510 Roosevelt Street stated that his property was flooded <br /> after Mr. Johnson filled his property and he felt that the Villa4geson <br /> should pay <br /> the cost of the improvement. The Village engineer informed Mr. that <br /> prior to 1961, no grades were set on private property being developed and also <br /> that the Village had always assessed storm sewer projects against the drainage <br /> area effected. Mr. John Mumford, 3508 Roosevelt Street stated that his prop- <br /> erty had been flooded and that water had entered a rear walk out entrance <br /> causing damage to appliances located in his basement. Councilman Bailey <br /> stated that he had been opposed to the Village solving private drainage <br /> problems, but felt that this matter was different. Councilman Sorenson stated <br /> that he felt the residents should get relief and that the flooding was causing <br /> damage to several homes. He stated that he would favor the project if the <br /> property owners assumed the total cost of the project. Mrs. Johnson stated <br /> that they had filled their property to keep the water from entering their <br /> home and that they had not put the water on other property. Mr. Aggeson stated <br /> that he felt the Johnsons had caused the diversion of the water by filling <br /> their property. Mr. Mumford indicated he was willing to close off his walk <br /> out door if it would solve the problem, but he felt that the two properties <br /> on 35th Street should be included in the project. Councilman Bailey felt the <br /> easement to be the number one problem, and asked if the owners of properties in <br /> the drainage area were willing to assume the cost of the project. No opposit- <br /> ion was expressed. Mr. Mumford inquired as to the type of easements along <br /> the rear property line and he was informed by the Mayor that they were for <br /> utility purposes. Mr. Johnson asked what the estimated cost would be per lot <br /> and was informed by Mr. Haik that it would be approximately $300.00 per lot <br /> if easements were not secured. He also stated that the amount could be com- <br /> puted on a square foot basis. Councilman Bailey asked if the Village Public <br /> Works Department could construct the project and was informed that it could, <br /> weather permitting after October 1, 1966. There being no further discussion, <br /> the Mayor declared the hearing closed. Councilman Sorenson introduced <br /> Resolution No. 66-063 and moved that it be adopted. <br />
