-2- <br /> ORDINANCE <br /> 2-ORDINANCE 1970-7 <br /> AN ORDINANCE RELATING TO SEWER RENTAL <br /> RATES, AMENDING SECTION 410.01 OF THE <br /> 1968 CODE OF ORDINANCES <br /> Motion carried. <br /> The Village Engineer appeared and discussed Street Improvement Project 1968-4 <br /> and explained the defective concrete paving and the cost of it, etc. and <br /> recommended that the Village not pay the $9,523.54 for this defectiveness; but <br /> instead to put this amount in a fund to be used later for repairs, if and when <br /> needed. <br /> Motion by Councilman Crouse and seconded by Mayor Miedtke to follow the recommend- <br /> ation of the Village Engineer and not pay the contractor this $9,523.54 and that <br /> this amount be held in a construction fund for future maintenance on this project <br /> for a period of three years, stipulating that it be put in a sinking fund after <br /> that. <br /> Motion carried. <br /> The Village Engineer submitted Estimate No. 8 for Street Improvement 1968-4 and <br /> presented the addition of Change Order costs to the original lump sum bid. He <br /> also presented the adjustments and the amount already paid on this contract, <br /> leaving a balance now due of $111,241.17. <br /> • Motion by Councilman Crouse and seconded by Councilman Levandowski to pay the <br /> balance due on Improvement Project 1968-4 in the amount of $111,241. 17, after the <br /> Village office has verified the total amounts already paid on this project. <br /> Motion carried. <br /> Motion by Mayor Miedtke and seconded by Councilman Englund to table action on the <br /> storm sewer construction agreement with the Minnesota Highway Department. <br /> Motion carried. <br /> Motion by Councilman Crouse and seconded by Councilman Emond authorizing the <br /> Village Attorney to contact the attorney for Rob3rt Vorpahl, if he has one, and <br /> find out what their intentions are in regard to the contest of election and also <br /> if there is any possiblity of this case being dismissed. <br /> Motion by Councilman Englund and seconded by Councilman Levandowski amending the <br /> motion that if they do not want to have this case dismissed, that the Village <br /> Attorney should proceed with the next step necessary to finalize this case. <br /> Voting on the amendment: <br /> Aye: Emond, Miedtke, Levandowski, Englund <br /> Nay: Crouse <br /> • Amendment carried. <br />
