-2- <br /> the Council as early as possible in November. <br /> • Motion by Councilman Stauffer, seconded by Councilman Sundland to adopt <br /> Resolution 74-027 and set the interest rate at 8% with assessment to be spread <br /> over 5 years. <br /> RESOLUTION 74-027 <br /> RESOLUTION ADOPTING ASSESSMENT ROLL FOR PAVING, CURB <br /> AND GUTTER PROJECT IMPROVENT 1973-1 <br /> Motion carried. <br /> Mr. John Prueter, 7700 Logan Avenue South, Mpls., Mr. George Nason, 2210 <br /> Duswell Avenue, St. Paul, and Elizabeth B. Hanley, Attorney, Engineer and <br /> President respectively of the Sunset Memorial Park Association, attended the <br /> meeting and Mr. Prueter stated that they were objecting to the amount which had <br /> been levied against the cemetary association to pay for the storm sewer system. <br /> Mayor Miedtke pointed out that the Sunset Memorial assessment represented only <br /> for their share of participation in the cost of the pipe built by Minneapolis, <br /> St. Anthony and the Highway Department into which the cemetary's own storm sewer <br /> flowed. He told Mr. Prueter that the assessments were based not only on the <br /> cost of the pipe which lay within the confines of St. Anthony but for the <br /> entire storm sewer system as it carried waste waters to the river. The attorney <br /> questioned why the Hillside Cemetary Association was identified on the mailing <br /> lists with the Sunset Memorial Park address. Mr. Fornell was called from the <br /> Is <br /> Planning Board meeting in another part of the building to further clarify the <br /> source of the data which was used to compute the individual asssessment rates. <br /> The City Attorney told the Council that the cemetery association objections <br /> should not delay their passing the resolution approving the assessment rolls for <br /> the storm sewer. <br /> Martin Rainer, 282+ Highway 8, said the above discussion had cleared up some <br /> questions in his mind regarding the method of assessment and was told he had 39 <br /> days from the date of the resolution to pay up his assessment without interest. <br /> Mr. & Mrs. Walter F. Bochnak, 418 9th Avenue N.E.J. were present and wondered <br /> what portion of the vacant lot they own at 3510 Belden Drive was affected by the <br /> storm sewer assessment since the lot is located at the crest of the hill. A <br /> A check of the assessment listings indicated that theirs was only a partial <br /> assessment for the portion of the lot from which water flowed in a southerly <br /> direction. <br /> Before the following motion was made, a memo from Jim Fornell indicating four <br /> adjustments to be made in the calculations were included in the assessment roll: <br /> Motion by Sundland, seconded by Miedtke to adopt Resolution 74-028. <br /> RESOLUTION 74-028 <br /> A RESOLUTION ADOPTING ASSESSMENT ROLL FOR <br /> STORM SEWER IMPROVEMENT PROJECT 1972-1 <br /> Interest rate to be 7% to be spread over 10 years. <br /> Motion carried. <br /> • Motion by Councilman Sundland, seconded by Councilman Sauer to adopt <br /> Resolution 74-029 . <br /> A RESOLUTION APPROVING THE <br /> 1975 BUDGET <br /> Motion carried. <br />
