• Mrs. Michaelhoff referred to the expenses she had incurred in seeking funding for <br /> the construction of the same house on the lot she owns at the corner of 37th <br /> Avenue N.F. and Silver Lake Road. Mayor Miedtke said he did not feel this hard- <br /> ship would warrant a variance from the City ordinances and pointed out the fire <br /> hazards produced by constructing buildings too close to each other to allow easy <br /> accessibility by fire fighting equipment which he said was one of the basis for <br /> the side yard requirements in the zoning ordinance. <br /> Motion by Mayor Miedtke, seconded by Councilman Stauffer to follow the recommend- <br /> ations of the Planning Board to deny the request of Mrs. Dale Michaelhoff, 906 W <br /> County Road D. for a side yard variance of 5 feet to build a 68 foot house at <br /> 3604 Downers Drive. <br /> Votion on the motion: <br /> Aye: Miedtke, Stauffer, Sundland <br /> Abstaining: Haik <br /> ,Motion carried. <br /> Mr. Letourneau gave the reasons the Planning Board had not held a public hearing <br /> on the Bernu Company proposal to place a free standing sign in front of the <br /> building they are erecting in the St. Anthony Office Park and Mr. Dulgar told <br /> the Council that Mr. Rod Bernu had informed him that the company had run into <br /> soil conditions which would warrant a revision of the site plans for the project <br /> and had requested they be allowed to present the plan changes later in the <br /> evening. <br /> • Action on the matter was deferred for the arrival of Mr. Bernu as well as other <br /> members of the Planning Board who had been invited to attend the Council meeting <br /> ` _ later that evening. <br /> After Mr. Letourneau explained that the proprietor of the Village Inn Cafe was <br /> unwilling to pay the filing fee for an application on a sign variance as long as <br /> it was not refundable if the application was refused Mr. Letourneau told of the <br /> Board's desire for an examination of the equity of all filing fees. <br /> Motion by Mayor Miedtke, seconded by Councilman Sundland to direct the Manager to <br /> review all licenses and variance filing fees and report back to the Council on <br /> the administrative costs of processing such requests and their relationship to <br /> the amount of the filing fees. <br /> Motion carried. <br /> The Planning Board representative told the Council of the completion of the <br /> Board's work on the revision of the City's zoning ordinance and a joint meeting <br /> of the Council and the Board to discuss the recommendations for revision was set <br /> for November 5, 1974. <br /> Motion by Councilman Sundland, seconded by Councilman Haik to waive the readings <br /> and adopt Ordinance 1974-oo6. <br /> • ORDINANCF 197+-oo6 <br /> AN ORDINANCF RFIATING TO VFTFRANS DAY AS A <br /> HOLIDAY: AMEMING SFCTION 135:54 OF THE 1973 <br /> CODE OF ORDINANCFS. <br /> Motion carried. / <br />
