Motion by Councilman Stauffer, seconded by Councilman Haik to commend the City <br /> Water Department on their attaining a zero disabling injury frequency rate for <br /> the year of 1973 and twelve years prior as cited by the American Water Works <br /> Association in their letter of congratulations. <br /> Motion carried. <br /> Mr. I.C. Comstock, City Engineer explained his recommendations that the Council <br /> enforce the liquidated damages penalty from October 1 until the water pressure <br /> system installed by the Irving Lamppa Construction Company is operational as set <br /> out in the City's contract with Lamppa. He stated that the contractor had been <br /> very uncooperative, uncommunicative and had actually had another company do all <br /> the work on the Water Improvement Project without Council approval and had <br /> provided no supervision of the work at all. The Engineer felt the provisions of <br /> the contract which the Lamppa Company had agreed to should be enforced. He then <br /> advised that all residents who might be affected when the new system was tested <br /> should be alerted to possible complications which might develop during the test. <br /> Motion by Councilman Sundland, seconded by Councilman Haik to follow the recommend- <br /> ations of the City Engineer and enforce the liquidated damages penalty of the <br /> contract with the Irving Lamppa Construction Company on the Water Pressure Project <br /> 1974-1 from October 1, 1974 and to request the contractor to delay the testing of <br /> the system until all the residents who might experience difficulties in their <br /> water systems had been so notified. <br /> Before the vote was taken on the motion the consequences of having the test taken <br /> before such notifications could be made were considered and led to the following <br /> motion to table: <br /> Motion by Mayor Miedtke, seconded by Councilman Stauffer to table action on the <br /> previous motion until the next Council meeting. <br /> Voting on the motion to table: <br /> Aye: Miedtke, Stauffer <br /> Nay: Sundland, Haik <br /> Motion not carried. <br /> When reassured that the motion to table did not forego the payment of the penalty <br /> and considering the advice of the Engineer that the penalty could be enforced at <br /> a later date, Councilman Sundland reconsidered his vote against tabling. <br /> Recalling the motion to table: <br /> Aye: Sundland, Stauffer, Miedtke <br /> Nay: Haik <br /> Motion to table carried. <br /> Mr. Dulgar then told the Council he felt the best way to avoid problems with the <br /> testing of the system was to have City personnel go from house to house to in- <br /> form the residents that they could call the City offices for help in turning off <br /> their water, etc. if any problems result. <br /> Motion by Mayor Miedtke, seconded by Councilman Stauffer to deny the Lamppa <br /> request of October 1st for additional time because of lack of adequate informat- <br /> ion and details of the reasons supporting the delay. <br /> Motion carried. <br />
