The letter from Hans Selvog regarding his work with the youth of the community
• was filed and the invitation again repeated to the Council to attend the
Human Relations Committee meeting at 7:00 P.M. November 19th.
Mr. Frederick Herfurth, President, and Mrs. Carol Brown, Office Manager of the
Herfurth Real Estate Company presented their request that their application
for a conditional use permit for a real estate office be reconsidered by the
Council as it had previously been tabled.
Mr. Herfurth said he thought the request had been for rezoning the property
he had purchased at 3901 Silver Lake Road to commercial but conceded he only
had a record of a request for a conditional use permit which the Planning
Board had given approval contingent upon a retirement complex being erected
on the adjoining property. The realtor only had the initial landscaping plans
with him which were not the plans finally approved by the Planning Board, a
survey of the property and a sketch illustrating the proposed renovation of
the Holien home and garage to serve as a real estate office.
The meeting was recessed at 8:35 P.M. and reconvened at 8:47 P.M. for a
resumption of the discussion and the following motions:
Motion by Mayor Miedtke, seconded by Councilman Sauer to remove from tabled
the request from the Frederick Herfurth Real Estate Company for a conditional
use permit to establish a real estate sales office at 3901 Silver Lake Road.
Voting on the motion:
Aye: Sauer, Sundland, Miedtke, Stauffer
Nay: Haik
Motion carried.
Councilman Haik said she was still opposed to rezoning the property from
Residential because she feared it would set a precedent for dealing with the
other undeveloped property in that area. Councilman Stauffer wanted the
adjoining land, especially the north portion of the area in question; to be
reevaluated to preserve the R-1 nature of the back lots, and was concerned
that granting the permit should not substantially diminish the property values.
Councilman Sauer felt the proposal was the closest the Council could get to a
residential use of -the property.
Motion by Mayor Miedtke, seconded by Councilman Stauffer to grant a condition-
al use permit to the Frederick Herfurth Realty Company to convert the buildings
on Lot 1, Block 1 of Holien's lst Addition to a real estate sales office
subject to the following conditions:
1. Maintenance of the appearance of the buildings on the property to be in
a residential nature.
2. Payment of the application fee by the Herfurth Company.
3. Receipt and approval of parking plans with only one curb cut on 39th
Avenue N.E. and landscaping plans as relating to the final parking layout.
4. Required easements to be approved with the parking plans.
5. Review and approval of the plans by the Fire Dept. and Building Inspect-
or.
6. Conditional use permit to be non-transferrable.
7. No additional buildings to be erected on the property.
