The letter from Hans Selvog regarding his work with the youth of the community <br /> • was filed and the invitation again repeated to the Council to attend the <br /> Human Relations Committee meeting at 7:00 P.M. November 19th. <br /> Mr. Frederick Herfurth, President, and Mrs. Carol Brown, Office Manager of the <br /> Herfurth Real Estate Company presented their request that their application <br /> for a conditional use permit for a real estate office be reconsidered by the <br /> Council as it had previously been tabled. <br /> Mr. Herfurth said he thought the request had been for rezoning the property <br /> he had purchased at 3901 Silver Lake Road to commercial but conceded he only <br /> had a record of a request for a conditional use permit which the Planning <br /> Board had given approval contingent upon a retirement complex being erected <br /> on the adjoining property. The realtor only had the initial landscaping plans <br /> with him which were not the plans finally approved by the Planning Board, a <br /> survey of the property and a sketch illustrating the proposed renovation of <br /> the Holien home and garage to serve as a real estate office. <br /> The meeting was recessed at 8:35 P.M. and reconvened at 8:47 P.M. for a <br /> resumption of the discussion and the following motions: <br /> Motion by Mayor Miedtke, seconded by Councilman Sauer to remove from tabled <br /> the request from the Frederick Herfurth Real Estate Company for a conditional <br /> use permit to establish a real estate sales office at 3901 Silver Lake Road. <br /> Voting on the motion: <br /> Aye: Sauer, Sundland, Miedtke, Stauffer <br /> Nay: Haik <br /> Motion carried. <br /> Councilman Haik said she was still opposed to rezoning the property from <br /> Residential because she feared it would set a precedent for dealing with the <br /> other undeveloped property in that area. Councilman Stauffer wanted the <br /> adjoining land, especially the north portion of the area in question; to be <br /> reevaluated to preserve the R-1 nature of the back lots, and was concerned <br /> that granting the permit should not substantially diminish the property values. <br /> Councilman Sauer felt the proposal was the closest the Council could get to a <br /> residential use of -the property. <br /> Motion by Mayor Miedtke, seconded by Councilman Stauffer to grant a condition- <br /> al use permit to the Frederick Herfurth Realty Company to convert the buildings <br /> on Lot 1, Block 1 of Holien's lst Addition to a real estate sales office <br /> subject to the following conditions: <br /> 1. Maintenance of the appearance of the buildings on the property to be in <br /> a residential nature. <br /> 2. Payment of the application fee by the Herfurth Company. <br /> 3. Receipt and approval of parking plans with only one curb cut on 39th <br /> Avenue N.E. and landscaping plans as relating to the final parking layout. <br /> 4. Required easements to be approved with the parking plans. <br /> 5. Review and approval of the plans by the Fire Dept. and Building Inspect- <br /> or. <br /> 6. Conditional use permit to be non-transferrable. <br /> 7. No additional buildings to be erected on the property. <br />
