• plat review of the property into the 12 lots , as indicated. <br /> Motion carried unanimously. <br /> Motion by Councilman Haik and seconded by Councilman Sundland to adopt <br /> the resolution providing for the reassessment and apportionment of <br /> certain dropped special assessments which had been previously levied <br /> against the Diamond 8 Apartments and Apache Plaza. <br /> RESOLUTION 77-039 <br /> A RESOLUTION PROVIDING FOR THE REASSESSMENT AND <br /> APPORTIONMENT OF CERTAIN SPECIAL ASSESSMENTS PREVIOUSLY LEVIED <br /> Motion carried unanimously. <br /> The Council then considered the data which had been provided them by <br /> Mr. Fornell for making a determination of what costs should be assessed <br /> to property owners for the improvement of 29th Avenue N.E . Omar Shabez <br /> and Tom Shaeffer of T.A.P. 29th Avenue N.E. were present for the discus- <br /> sion. <br /> Consultation with the City Attorney and Acting City Manager resulted in <br /> the agreement that the percentage of the total costs which was to be <br /> assessed to the property owners would have to be determined for inclusion <br /> • in Resolution 77-040 which could be used by the Acting City Manager as <br /> a guideline for determining what the individual assessments would be. <br /> Mr. Scth answered Councilman Sauer ' s question of whether the assessment <br /> amour., through a line by line consideration of the cost elements furnished <br /> by ;- . Fornell , but Councilmen Haik and Sundland felt this was unnecessary <br /> sir_c- it was their contention that all the MSA funds received by the <br /> City for this street could be used for its reconstruction. <br /> Co:,. cilman Sundland saw the "more liberal" figure for the assessment, as <br /> projected by Mr. Fornell, as resulting in an average assessment per parcel <br /> of Ubout $1 , 436 which he said was not too far off his own estimate in <br /> 1976 of $1 , 400 . However, he could not accept using the individual curb <br /> gutter allowance figures provided, because he felt that although there <br /> were nc prior assessments for curbs and gutter recorded for some of the <br /> parcels east of Silver Lake Road, those homeowners had probably paid for <br /> the improvements through original purchase price on their homes and felt <br /> it would be fairer that all parcels along 29th should therefore be treated <br /> equally and the gross curb and gutter costs averaged out to include all <br /> parcels . <br /> Both Councilmen Haik and Sundland felt the residents on 29th deserved <br /> special treatment in assessment policy because of the heavy use of their <br /> street by other motorists . They agreed that if it were necessary to use <br /> the major portion of the MSA funds allocated to the City for the prcject, <br /> any other road construction in the community should be delayed until the <br /> reserves were built up again. <br /> (3) <br />
