-2- <br /> to <br /> 2- <br /> to and will advise in the planning and administering of the recreation and <br /> adult education programs to be conducted by the Recreation Director on or in <br /> the facilities under said Superintendent's jurisdiction. <br /> 7) It is further agreed that in the event of any dispute or difference arising as <br /> a result of the Recreation Director 's program being conducted on the sites <br /> jointly used and selected, as outlined above, or as to the use of a school or <br /> Village facilities, then, in the event, said dispute or difference shall be <br /> settled and arbitrated by appealing to both sponsoring authorities in joint <br /> session. <br /> 8) It is agreed that the Village will furnish and supply all expendable materials <br /> necessary for carrying on a community recreational program for all ages. <br /> 9) It is further agreed that the cost of maintaining said areas shall be borne by <br /> the owning authority. <br /> 10) It is further understood and agreed that either party to this agreement may at <br /> any time terminate this agreement upon giving, in writing, to either party by <br /> September 1st, notice of its intention to terminate by June 30th of the follow- <br /> ing year. <br /> 11 ) It is agreed that the Village shall hold harmless and free from liability the <br /> School District, its officers, agents, servants, or employees, while acting as <br /> such, from all damages, cost or expenses, which any of them shall become <br /> • obligated to pay by reason of liability impaired by law because of injury to <br /> or death of person, received or suffered by reason of operation of the commun- <br /> ity recreational and adult program upon said premises. <br /> 12 ) It is further agreed that the School District shall hold harmless and free <br /> from liability the Village, members of its Village Council , board or commission, <br /> its officers, agents, or employees while acting as such, from all damages, <br /> costs or expenses which any of them shall become obligated to pay by reason <br /> of liability imposed by law because of injury to property or injury to or <br /> death of persons, received or suffered by reason of use of any of said in- <br /> stallations or equipment in connection with the School District program while <br /> under the supervision or control of the School District. <br /> 13 ) It is understood and agreed that the salary for the Recreation Director will <br /> be shared equally by the Village and School District. <br /> 14) It is further agreed the Recreation Director will submit the recreation budget <br /> and plans to the Village Council and to the School Fbard by September 1st for <br /> the following fiscal year of July 1st to June 30th. <br /> 15) It is agreed that all funds be handled and dispursed through the Village <br /> Treasurer. <br /> 16) It is agreed that the Recreation Director shall be hired by and report to the <br /> Village Manager. The School Board shall be consulted and they or their desig- <br /> nated agent shall approve any job offers prior to the Village Manager issuing <br /> each offer. All personnel action concerning the Recreation Director shall be <br /> initiated by the Village Manager. The Village Manager has the authority to <br /> suspend or fire the Recreation Director. <br />
