• 6 . Ordinances and Resolutions <br /> A. Resolution 77-042. A Resolution Modifying the 1977 Budget. <br /> The resolution decreases the appropriation in the winter <br /> part-time maintenance account and increases the appropriation <br /> in the summer part-time -maintenance account. <br /> ACTION: Recommend Approval. <br /> B. Resolution 77-046 . A Resolution Modifying the 1977 Budget. <br /> This is an "in and out" transfer of funds received from the City <br /> of Columbia Heights for gasoline to increase the appropriation <br /> to the account from which gasoline is purchased. <br /> ACTION: Recommend Approval . <br /> 7. Old Business <br /> A. American Legion Post No. 513 request for an "on-sale" club <br /> liquor license. The City attorney has made a very thorough re- <br /> view of Statutes regulating the issuance of these licenses . <br /> As noted, it appears that State Statutes are confusing. The <br /> City attorney feels that the City does have the authority to <br /> issue such a license but points out several requirements and/ <br /> or' problems. If the Council wishes to grant the license, I <br /> recommend the following conditions : (1) The license be restricted <br /> to the present confines of the Club or, better yet, the basement <br /> level (on the application the Post specifies "basement" - this <br /> • would be agreeable to them) ; (2) The Club be required to also <br /> be licensed for a "set-up" license at $300 per year, and (3) The <br /> license be nonrenewable, if legally permissible (see attorney' s <br /> comments page 5) . It should also be noted that the City can <br /> require a $3 ,000 - $5, 000 surety bond. The Legion possesses a <br /> $3,000 bond plus they will have $100 ,000 in Dram Shop liquor <br /> insurance. The license application is dated (notarized) Septem- <br /> ber 15th, exactly one-half year from the March 15th license <br /> expiration date so under City ordinance they could be charged <br /> $50. 00 rather than $100.00 for the license. The Club would <br /> not start operations until October 1, 1977 . <br /> ACTION: Review and, if all facts are present, decide on <br /> the issuance. <br /> 8. New Business - None <br /> 9 . Communications/Petitions <br /> A. Metro Transit Commission re: passenger waiting shelters. The <br /> shelter at approximately 4000 Silver Lake Road has been approved <br /> and one is contemplated at 37th and Silver Lake Road. If you <br /> have any ideas, let me know. <br /> ACTION: Make proposals where the Council feels there is <br /> a need and sufficient room. <br /> • <br /> (2) <br />
