-2- <br /> Councilman <br /> 2-Councilman Dougherty read a petition as submitted by Mr . Flaherty. The petition <br /> consisted of 19 pages and 257 signatures. Mr. Flaherty asked that the petition be <br /> returned. The Mayor indicated that it would be returned when it was copied for <br /> Village records. <br /> James McNulty criticized the special meeting of January 15, 1969 and challenged its <br /> legality. He also inquired as to why the present meeting was not held in larger <br /> quarters. <br /> The Planning Board Minutes of their meeting of January 21 , 1969 were presented by <br /> Mr. Donald Kronk. <br /> Motion by Mayor O' Connor and seconded by Councilman Emond that a request of the <br /> Walter R. Hammond Co. to relocate a sign from former building to 3601 - 29th Avenue <br /> N. E. be denied. <br /> Motion carried. <br /> Motion by Councilman Dougherty and seconded by Councilman Levandowski that the <br /> request by Albert Villella for a front yard variance for the construction of a <br /> garage be tabled to work out an alternate proposal with the Planning Board. <br /> Motion carried. <br /> Motion by Councilman Dougherty that the request of William Sauer to rezone the <br /> • lot East of the Dairy Store on 37th Avenue N. E. from Light Industrial to Commercial <br /> be denied. <br /> No second to motion. <br /> Mr. Sauer presented a plot plan of the property with a front elevation of the <br /> building. He stated that his proposal would provide parking spaces for 23 cars. <br /> Mr. Lou Howitz, Planning Board Chairman briefly discussed the Planning Boards <br /> recommendation on the hearing. <br /> Motion by Mayor O'Connor and seconded by Councilman Levandowski that the Planning <br /> Board be directed to hold a public hearing on the rezoning from Light Industrial <br /> to Commercial , the following described property: The East 90 78/100' of the South <br /> 125' of Lot 5, Block 3, Mounds View Acres Second Addition. <br /> Voting on the motion: <br /> Aye: O'Connor, Emond, Levandowski . <br /> May: Dougherty. <br /> Motion carried. <br /> Mr. Hasty appeared regarding a request for zoning change. He stated his property <br /> was located next to the School property on 37th Avenue N. E. and the lot size was <br /> 85' X 220'. He requested consideration of a zoning change from R1 to R2 because <br /> of the location of the property 4n/d the existence of power line tower 30' from his <br /> property. Mr. Howitz noted that,'the Planning Board felt that no hardship existed <br /> because of the proximity of the school property. <br /> Motion by Councilman Dougherty seconded by Mayor O'Connor that due to hardship, I <br /> a hearing be held by the Planning Board to consider the rezoning of Mr. Hasty's <br />
