w <br /> • -2- <br /> The <br /> 2-The public hearing in regard to the development of the Gaza Strip was continued. <br /> The attorney for Mr. Harvey Coleman talked on the proposed changes in the <br /> Protective Covenant. <br /> Curt Englund, Silver Lane, talked in favor of the Protective Covenant, stating <br /> that it was what he wants. <br /> Robert Johnson, Silver Lake Court, representing the residents of that area, said <br /> they wanted as full and complete protection as they could get. <br /> Richard Merrill, Silver Lane, was not sure the Protective Covenant would give <br /> them the fullest protection and felt that possibly platting might give the <br /> residents better protection. <br /> Village Attorney, Loren Knott, discussed the merits of both solutions, the <br /> Protective Covenant and the platting. <br /> Mr. Johnson recommended that possibly a combination of the two solutions might <br /> be acceptable to the residents. <br /> • Mr. Coleman stated that he wanted it put on record that he would provide the <br /> Village of St. Anthony with an executed copy of the Protective Covenant and that <br /> this covenant will be placed on record before the issuing of a building permit. <br /> The public hearing on the Gaza Strip development was declared closed at this time. <br /> Motion by Councilman Crouse and seconded by Councilman Emond that we require this <br /> property be platted before occupancy into two lots, 4/9 and 5/9, and that the <br /> 150 foot strip bordering Silver Lane be dedicated on the plat for scenic and <br /> open space landscaping and drainage as approved by the Village and that the <br /> Council receive a copy of the Protective Covenant prior to the issuing of the <br /> building permit and favorable approval of this at the first reading. <br /> Motion carried. <br /> Mr. Gingold, architect for Mr. Coleman, requested that they be allowed to use <br /> materials other than the brick and stone as required. He requested that they <br /> be permitted to use stucco and wood in parts. <br /> Motion by Councilman Kukielka and seconded by Councilman Emond to approve the <br /> plans as presented with a variance and to authorize the use of stucco in parts <br /> and that this approval is given and become effective when the zoning ordinance <br /> has been amended to allow development according to the plot plan. <br /> Motion carried. <br />
