They all felt outsiders might mis- <br /> takenly consider their property to be public park area. Another <br /> condominium owner, Burton Emerson, said he had paid a premium price <br /> for his property adjoining the lake and was often distrubed by people <br /> parking late at night under his bedroom windows. A New Brighton <br /> resident, K.D. Messer, .592 Rolls Road, said he has lived on the pond <br /> twelve years and maintained 50 feet of back yard down to the pond <br /> and he wondered if it should prove necessary to erect a fence to <br /> separate the public from private property, who would be responsible <br /> for erecting such a fence. <br /> Councilman Stauffer and Haik agreed that the City owned it to the <br /> residents of that area which is so densely populated and isolated to <br /> develop some recreation and open space for them on the publicly owned <br /> property. Councilman Haik told the opponents of the pathway that <br /> she also lived on a-lake-, Silver Lake, which is-public property and <br /> she and her neighbors have found it is up to them to delineate out- <br /> siders who use the lake, the division of public and private property <br /> and her experience had been that most people were very cooperative <br /> once they became aware of the distinction. Councilman Stauffer also <br /> pointed out to the condominium owners the fact that the apartment <br /> dwellers on the other side of the pond also should get some benefit <br /> from the City owned natural resources in that area and wondered if <br /> many of the property owners adjacent to the holding pond had not <br /> • erroneously considered the land fronting on the pond as their own <br /> when is reality it belongs to the City. The Mayor suggested it might <br /> be advisable to have the City indicate by staking where its property <br /> extends since the condominium owners are evidently having difficulty <br /> getting this information from the builders . Dennis Engle, represent- <br /> ing the owners association board said there are 148 other units in <br /> the complex besides the four who spoke and a majority of these had <br /> indicated they favored such a pathway be built for walking and jogging <br /> purposes but agreed to take another survey to affirm the previous <br /> poll of Mirror Lake Manor. <br /> Councilman Sauer and Sundland said they would like to postpone a de- <br /> cision on the pathway until the poll has been taken and all residents <br /> near the pond had been notified regarding the City's plans to con- <br /> struct the chip walkway around the pond. It was also agreed that the <br /> City should provide an access to the recreation area. <br /> Motion by Mayor Miedtke and seconded by Councilman Stauffer to table <br /> any action on the chip pathway on the City' s property around the <br /> perimeter of Mirror Lake until all the City residents in the area of <br /> Highcrest, Foss Road and 37th Avenue N.E. who live in the vicinity of <br /> the lake as well as New Brighton neighbors have been informed of the <br /> City' s plans. <br /> Motion carried unanimously. <br /> (4) <br />
