Resolution 01-062, Adopt Joint and Cooperative Agreement for Use of Law Enforcement <br /> 3 Personnel and Equipment. <br /> 4 Mornson stated that this agreement was to replace the former agreement they had with Hennepin <br /> 5 County since 1968. Essentially, he stated, it is the same agreement which gives the City of St. <br /> 6 Anthony the ability to call other Hennepin County communities for mutual aid, as well as to have <br /> 7 other communities call the City of St. Anthony for mutual aid. <br /> 8 Mayor Cavanaugh asked Morrison what he had found out with Minneapolis. Morrison responded <br /> 9 that he had not heard anything yet. <br /> 10 Motion by Councilmember Thuesen to adopt Resolution 01-062, re: Adopt Joint and <br /> 11 Cooperative Agreement for Use of Law Enforcement Personnel and Equipment. <br /> 12 <br /> 13 Motion carried unanimously. <br /> 14 B. Resolution 01-063, re: Waive monetary limits on tort liability. <br /> 15 Mornson stated that the Resolution was one to waive tort liability limits for LMCIT (League of <br /> Minnesota Cities Insurance Renewal) Insurance Program. He stated it was an annual resolution <br /> 17 done in conjunction with the insurance renewal. <br /> 18 Mornson introduced Carl Bennetsen of Gallagher Insurance, who assisted them with the <br /> 19 preparation of their insurance renewal with the league, to review the Gallagher Insurance. Mr. <br /> 20 Bennetsen indicated that Minnesota statute states that, regarding tort liability, the limits remain <br /> 21 $300,000 per an acclaimment, and$1,000,000 per an occurrence, which applies to Minnesota <br /> 22 statutes only. <br /> 23 Mr. Bennetsen stated that the City if St. Anthony has decided to waive the $300,000 per an <br /> 24 acclaimment limit up to the limits of the City's coverage. He indicated that the thought process <br /> 25 behind that decision was that, should a member of the community have an injury due to <br /> 26 negligence on behalf of the city which would require ongoing treatment, it is expected that <br /> 27 person would be a good citizen, by which the City would be able to apply up to $1,000,000 <br /> 28 limits per that injured party. He stated that the opposite point of view is that, if there were more <br /> 29 than one person injured, the City does not have that$300,000 limit. <br /> 30 Councilmember Sparks asked how it would work if there were four, or five people injured. Mr. <br /> 31 Bennetsen stated that the $1,000,000 would be divided between whoever would receive an award <br /> 32 under the policy. He stated that under the $300,000 policy, there would be $300,000 per <br /> 33 acclaimment, and up to$1,000,000 per occurrence. <br /> 0 Mayor Cavanaugh asked what the cost difference was in the insurance, if they chose to not waive <br /> 35 the $300,000 per acclaimment. Mr. Bennetsen stated that the difference was about$2,500. <br />
