-2- <br /> Mr. Jones arrived at 7 : 50 p.m. <br /> David Guckenberg and Paul Gray of North Central Food Systems, 3001 <br /> Metro Drive, appeared to discuss their request for a preliminary <br /> concept review of the proposal to build a Hardee ' s Restaurant on <br /> the vacant lot between the auto body shop and the Legion Club on <br /> Kenzie Terrace. Mr. Berg had advised in his July 12 memorandum <br /> that the proposal would require a rezoning from R-1 to C as well <br /> as a conditional use permit for the drive through facility . Mr. <br /> Guckenberg showed the preliminary site , landscaping and parking <br /> plans for the proposal and disputed there would be any problems <br /> with either parking or traffic congestion if the traffic flow <br /> were directed as proposed . The screening of the site from the <br /> adjoining residential should be a vast improvement over the exis- <br /> ting conditions on that lot now and he answered questions about <br /> the economic viability of the Kenzie area by telling the Board his <br /> firm would never plan a restaurant there unless market studies <br /> indicated it would be a success . He and Mr. Gray were certain <br /> signage could be modified to conform to the City ordinance and <br /> concluded the project would be abandoned if they didn 't get the <br /> go-ahead from the Board or strong neighborhood resistance were <br /> demonstrated. <br /> Because it appeared a restaurant might not fit into the comprehen- <br /> sive planning for the area being developed, the Board expressed <br /> their reluctance to encourage the proposal . Mr. Gray then said <br /> • he doubted his company would pursue the matter further. <br /> An application (later withdrawn) for a sit down restaurant further <br /> south on Kenzie Terrace had prompted the July 11 memorandum from <br /> the Administrative Assistant recommending an ordinance amendment <br /> which would close the loop hole in the parking requirements of the <br /> existing ordinance which "would have allowed a grossly inadequate <br /> parking area" if the request had been continued. Since sit down <br /> restaurants are not specifically addressed in the ordinance, the <br /> facility could have been built with only one parking space per 300 <br /> squar,a feet of building area as any other commercial building. He <br /> felt this type of facility should have the same parking restric- <br /> tions; as are specified for fast food and take-out restaurants . <br /> Motion by Mr . Jones and seconded by Mr. Rymarchick to make the <br /> additions suggested by Mr. Berg to the existing provisions of <br /> Section 12 , Subdivision 9 , Number 12 C (13) , parking regulations , <br /> as well as the definition of a sit down restaurant which is to be <br /> inserted in Section 2 , Rules and Definitions . <br /> Before voting on the motion, Mr. Bjorklund gave the example of <br /> underuse of parking provided for the Poppin Fresh Restaurant, <br /> which is an exceptionally successful restaurant, as the basis for <br /> his belief the proposed parking requirements would not be real- <br /> istic. Mr. Bowerman agreed, suggesting the question be researched <br /> further through the restaurant associations . <br />
