• CHAPTER 15 <br /> Minn.Stat.§462.355,surds.2, . Adoption of the plan.The agency recommends the comprehensive plan or <br /> 3. amendments, after a hearing date following a notice of 10 days <br /> publication in the official newspaper. The agency must submit the plan or <br /> proposed amendment of the council prior to publishing the notice. The <br /> council must formally adopt the plan as the official comprehensive plan, <br /> otherwise it remains only as a recommendation to the council. <br /> Minn.Stat.§462.356,subs. 1. . Recommendation for plan execution.The agency must study and propose <br /> ways to put the plan into effect, including zoning, subdivision <br /> regulations,official maps, a program of public improvements and <br /> services, city renewal and redevelopment, and a capital improvements <br /> program. <br /> Minn.Stat.§462.356,subd.2. . Review of land acquisitions and capital improvements.Once an agency <br /> adopts a comprehensive plan or part of a plan,all proposed land <br /> acquisitions and capital improvements of the city, or any other <br /> governmental unit with jurisdiction in the city,must go to the <br /> commission for review. The agency will then submit a written report <br /> describing its findings. (The council may,by two-thirds vote,dispense <br /> with this requirement if it feels no planning implications are involved.) <br /> Failure to report in 45 days is deemed approval. <br /> • . The planning commission or agency is responsible for reviewing land use <br /> control measures. The Planning Act requires the planning agency to <br /> review zoning ordinance amendments, subdivision plats,and official <br /> maps. Public hearings may be held before the planning agency,but the <br /> council makes the final determination.Under most city ordinances, all <br /> council determinations having planning implications first go to the <br /> planning agency. <br /> Minn.Stat §462.354.subd.2. * Finally,the planning agency or commission may get the assignment from <br /> the council to act as a board of adjustments and appeals. Again,every <br /> city that has a map in effect, must establish a board of adjustment and <br /> appeals.
