Planning Commission Regular Meeting Minutes <br /> May 19, 2009 <br /> Page 5 <br /> 1 Chair Stromgren stated the text amendment will be included on the May 26, 2009 City Council <br /> 2 meeting agenda. <br /> 3 <br /> 4 VII.2 LOT SPLIT REQUEST 4017 SILVER LAKE ROAD <br /> 5 <br /> 6 Chair Stromgren opened the public hearing at 7:53 p.m. <br /> 7 <br /> 8 Assistant City Manager Moore-Sykes presented the staff report for the proposed lot split for <br /> 9 4017 Silver Lake Road to create two single-family residential lots; 4017 Silver Lake Road and <br /> 10 proposed 4016 Penrod Lane. She stated earlier this year, Ms. Susan Lindberg contacted staff <br /> 11 looking for information about applying for a lot split of 4017 Silver Lake Road. Ms. Lindberg <br /> 12 had inherited this property and has had it on the market for sale. The marketing of this property <br /> 13 has produced an interested buyer for the portion of the current lot that would be vacant should <br /> 14 the lot split be approved by the City Council. <br /> 15 <br /> 16 Assistant City Manager Moore-Sykes stated a recent survey of the lot as it currently exists shows <br /> 17 it to be an interior lot of 21,214 square feet or .487 acres. Of this 21,214 square feet, 99 square <br /> 18 feet is reserved as a right-of-way for Silver Lake Road and 1,117 square feet that was originally <br /> 19 intended for an easement for an alley that was never used. The resultant lots, if the lot split <br /> 20 application is approved, would have Parcel A with 11,166 square feet, including the alley <br /> 21 easement and Parcel B with 10,048 square feet. Both parcels will be conforming lots as required <br /> 22 by the City's Zoning Ordinance with a minimum of 9,000 square feet. Parcel A will retain the <br /> 23 address of 4017 Silver Lake Road and Parcel B will be 4016 Penrod Lane. The buyer proposes to <br /> 24 build a single family structure once he closes on the purchase of Parcel B. Staff has asked the <br /> 25 City Attorney if it is necessary for the City to vacate the alley easement. He indicated that since <br /> 26 it is wholly contained within the lot and of no use, it is not necessary to vacate it. <br /> 27 <br /> 28 Ms. Susan Lindberg, applicant, addressed the Planning Commission. She noted that the first time <br /> 29 the lot was split it was split up the middle of the house. <br /> 30 <br /> 31 Commissioner Jensen questioned if there has been any discussion about having the back lot line <br /> 32 of the new vacant lot match the comers of the other lots on Penrod Lane. He pointed out that this <br /> 33 would create a bigger lot for the single family home fronting on Silver Lake Road that is more <br /> 34 likely to convert to something else in the future, and that the County sometimes requests more <br /> 35 frontage on Silver Lake Road. He stated his position that it would be wise for the applicant to <br /> 36 have the alley vacated while going through the recording of the property. <br /> 37 <br /> 38 Chair Stromgren noted the property is currently zoned R-1; any future development would <br /> 39 require a rezoning of the property. Commissioner Jensen commented that the Guide Plan <br /> 40 identifies a slightly more intense use of the property. <br /> 41 <br /> 42 Chair Stromgren closed the public hearing at 8:05 p.m. <br /> 43 <br /> 44 Motion by Commissioner Jensen, seconded by Commissioner Crone, to recommend approval of <br /> 45 the lot split for 4017 Silver Lake Road to create two single-family residential lots; 4017 Silver <br /> 46 Lake Road and proposed 4016 Penrod Lane. <br />
