2 <br />2009 Changes to Truth in Taxation Process <br />2009 Minn. Laws ch. The 2009 Legislature made significant changes to the truth -in- taxation <br />88, art. 3 amending Minn. requirements, essentially abolishing the old scheme of published notices, <br />stat. § 275.065, subd. 1. public hearings, and meetings. While apparently not the intent of the <br />legislation, the amended language contains no exception for smaller cities or <br />cities with levy increases less than or at the inflation price deflator (IPD). <br />The law seems to require that all cities follow this new process, but the <br />Department of Revenue views this as contrary to legislative intent and they <br />will not be enforcing the law with respect to cities under 500. However, <br />according to the Minnesota Department of Revenue, the exception for being <br />at or below the IPD is gone. So if a city increases their levy by 0.83 percent <br />or less that city is still subject to the new TNT process. <br />A. TNT Summary Chart <br />1. Plan regularly scheduled meeting agendas <br />early <br />July 2009 Be aware that cities must plan ahead and figure out which regularly <br />scheduled meetings will include discussion of the city budget and levy, <br />2009 Minn. Laws ch. 88, art. 3, § including the regularly scheduled meeting at which the final budget and levy <br />275.065, bds. Iandi3. stet. § will be adopted. Cities must <br />• announce this schedule, <br />• note it in council minutes (or proceedings), <br />publish it as required by law and <br />• provide the same specific meeting information to county auditors on <br />or before September 15. <br />2009 changes in the TNT law show legislators are most interested in city <br />councils including information on the budget and levy process in minutes <br />and dealing with these topics at regularly scheduled meetings. The published <br />notices and numerous meetings previously required were repealed by the <br />legislature. <br />MEMO NAME <br />2. Announce which regularly scheduled <br />meetings will include budget and levy <br />discussions and decisions <br />On or before Tuesday, <br />September is, 2009. <br />The law now requires that before September 15, 2009, at the regularly <br />scheduled meeting at which the city council adopts a proposed tax levy, the <br />2009 Minn. Laws ch. 88, art. 3, § <br />city council must also announce: <br />2 amending Minn. Stat. § <br />the time and place of the council's next regularly scheduled <br />275.065, subd. 1. <br />meetings at which the budget and levy will be discussed. Note: these <br />meetings must be held after 6 p.m. <br />• the date and time of the regularly scheduled meeting at which a final <br />budget and levy will be determined <br />MEMO NAME <br />
