City Council Regular Meeting Minutes
July 22, 2008
Page 2
D. Resolution 08 -045, Accepting a Donation from Kiwanis Club of St. Anthony.
Motion by Councilmember Stille, seconded by Councilmember Gray, to approve the Consent
Agenda items.
Motion carried unanimously.
IV. PUBLIC HEARING.

None.

V. REPORTS FROM COMMISSION AND STAFF.

A. Consider Resolution 08 -046; Conditional Use Permit for Twin Citv Christian Assembly
located at 2526 Highway 88, Northgate Business Center.

Planning Commissioner Crone presented background information regarding the Conditional Use
Permit (CUP) request for Twin City Christian Assembly (TCCA). She stated the Planning
Commission unanimously approved a recommendation to the City Council to grant the TCCA a
CUP for 2526 Hwy 88, Northgate Business Center, with the requirement for approval by the Fire
Marshal and Building Official for a Certificate of Occupancy. The Commission found that the
proposed use meets the requirements of a CUP as stipulated in the City's Zoning Ordinance,
Chapter 16.

Councilmember Stille questioned why the CUP request has not come forward previously, as the
applicant has been located at the site since 2006.

City Manager Morrison explained staff just learned of the occupant's use of the site due to the
requirement for an Occupancy Permit.

Councilmember Thuesen asked whether problems are foreseen if the number of individuals using
the site were to increase in the future.

Commissioner Crone replied TCCA has been in another location since 1990 and has had the
same approximate number of attendees. The maximum occupancy at this site is 100 people;
given TCCA's history they have room to grow. There are vacant businesses to the right and left
of this location with space that TCCA could expand into without changing the building structure.

Councilmember Roth questioned if a permit would be needed in order for the applicant to
expand into other space in the building.

City Manager Morrison replied an Occupancy Permit, and likely a Building Permit, would be
required to expand. Typically the CUP goes with the property it is requested for and the CUP is
limited to the square footage of that property. Depending on how the resolution is stated, the
applicant would likely need to request an amendment to the CUP in order to expand.
