City Council Regular Meeting Minutes <br />November 25, 2008 <br />Page 3 <br />2 Mayor Faust thanked the Planning Commission and staff for their work on the Comprehensive <br />3 Plan Update. <br />4 <br />5 B. Consider Resolution 08 -074: Ordering Transfer of Ownership and Preparation of <br />6 Feasibility Report for Arbors Alley Roadway and Utility Improvements <br />8 Mr. Hubmer reviewed the resolution with the Council and indicated that residents of the Arbor <br />9 Townhome Community have submitted a petition requesting the City to take ownership and <br />10 complete public street and utility improvements on the alley located immediately south of Croft <br />11 Drive and west of Old Highway 8. The alley is currently owned and maintained by the Arbors <br />12 Homeowners Association. The proposed resolution authorizes a feasibility study to consider the <br />13 City taking over ownership of the alley and completing reconstruction of the roadway and <br />14 utilities. <br />15 <br />16 Councilmember Thuesen questioned if the assessments would be the traditional 35/65 split. Mr. <br />17 Hubmer replied on an alley improvement such as this, assessments would be proposed at 100% <br />18 to bring the road up to city standards before the City takes ownership. <br />19 <br />20 Councilmember Thuesen asked if there are other alleys in the City that are similar to this where <br />21 the City has not taken control of the roadway. Mr. Hubmer replied there are one or two small <br />22 alleys that exist in the City. <br />23 <br />24 Councihnember Gray questioned if there is any precedent of the City taking over an alley in this <br />25 manner. Mr. Morrison responded in the negative. <br />26 <br />27 Councilmember Roth clarified with Mr. Hubmer that the alley is currently owned by The Arbors <br />28 Townhome Association. The Arbors does not physically have access to their property from this <br />29 alley and the watermain does not serve the Arbors site. However, The Arbors has ownership <br />30 responsibility for the maintenance of the watermain and maintenance of the roadway. There are <br />31 two residences that receive their water from this watermain. <br />32 <br />33 Councilmember Gray questioned why the resolution authorizes the transfer of ownership and the <br />34 feasibility study at the same time, rather than completing the feasibility study first. Mr. Hubmer <br />35 explained part of the feasibility study is exploring the issues associated with purchasing the <br />36 parcel. He noted the resolution was not intended to authorize a transfer of ownership. <br />37 <br />38 Mayor Faust clarified with Mr. Hubmer that the request is not to transfer ownership of the parcel <br />39 at this time. The request is to conduct a feasibility study on the utilities and to look at the issues <br />40 associated with the transfer of ownership. <br />41 <br />42 Mr. Hubmer indicated he will discuss the land transfer with the City Attorney.
