City Council Regular Meeting Minutes November 25, 2008 Page 4 1 "WHEREAS, it is proposed the City of St. Anthony and 2 improve..." 3 4 Councilmember Roth verified with Mr. Hubmer that the subject alley will be built to the same 5 standards as the alley behind his home on 27`h Avenue. 6 7 Motion by Councilmember Gray, seconded by Councilmember Stille, to adopt Resolution 08- 8 074, Ordering Preparation of Feasibility Report for Arbors Alley Roadway and Utility 9 Improvements (as amended above). 10 11 Councilmember Roth questioned who will pay for the feasibility study. Mayor Faust replied it is 12 paid for by the City. 13 14 Mr. Hubmer stated the feasibility costs would be added to the assessment if it is determined to go 15 forward with the improvement. 16 17 Motion carried unanimously, 18 19 C. Consider Ordinance 08 -007, Dangerous Dog Ordinance. (2 "d reading). 20 21 Mr. Mornson reviewed the ordinance with the Council and provided the following staff response 22 to questions raised by the Council during the first reading on November 12, 2008: 23 ■ 1205.01— Staff has deleted "cat" from this section to keep consistency in the ordinance. 24 ■ 1205.05 — The 10 -day period has been recommended by veterinarians for detecting 25 rabies. 26 ■ 1205.08 — This section does not reflect a period of time as we may need more than 10 27 days in some cases. Generally, if the owner has proof of the rabies shots, we implement 28 1205.05 and allow the owner to quarantine the animal for 10 days. The police department 29 has been told that this time period will, in most cases, reveal if the dog is sick. 30 ■ Staff did not define potentially dangerous dogs, as the hearing process only refers to 31 dangerous dogs. We will depend on State Statute for a variety of definitions rather than 32 reiterating State Statute in our ordinance. 33 34 Mr. Momson noted the appeals process outlined in Section 1205.11. 35 36 Motion by Councilmember Roth, seconded by Councilmember Gray, to hold second reading of 37 Ordinance 08 -007, Dangerous Dog Ordinance. 38 39 Motion carried unanimously. 40 41 VIL REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 42 43 City Manager Mornson reported on the following: 44 The next regular City Council meeting is scheduled for Monday, December 8, 2008 45 following the Truth in Taxation Public Hearing.
