City Council Regular Meeting Minutes <br />November 25, 2008 <br />Page 4 <br />1 "WHEREAS, it is proposed the City of St. Anthony and <br />2 improve..." <br />3 <br />4 Councilmember Roth verified with Mr. Hubmer that the subject alley will be built to the same <br />5 standards as the alley behind his home on 27`h Avenue. <br />6 <br />7 Motion by Councilmember Gray, seconded by Councilmember Stille, to adopt Resolution 08- <br />8 074, Ordering Preparation of Feasibility Report for Arbors Alley Roadway and Utility <br />9 Improvements (as amended above). <br />10 <br />11 Councilmember Roth questioned who will pay for the feasibility study. Mayor Faust replied it is <br />12 paid for by the City. <br />13 <br />14 Mr. Hubmer stated the feasibility costs would be added to the assessment if it is determined to go <br />15 forward with the improvement. <br />16 <br />17 Motion carried unanimously, <br />18 <br />19 C. Consider Ordinance 08 -007, Dangerous Dog Ordinance. (2 "d reading). <br />20 <br />21 Mr. Mornson reviewed the ordinance with the Council and provided the following staff response <br />22 to questions raised by the Council during the first reading on November 12, 2008: <br />23 ■ 1205.01— Staff has deleted "cat" from this section to keep consistency in the ordinance. <br />24 ■ 1205.05 — The 10 -day period has been recommended by veterinarians for detecting <br />25 rabies. <br />26 ■ 1205.08 — This section does not reflect a period of time as we may need more than 10 <br />27 days in some cases. Generally, if the owner has proof of the rabies shots, we implement <br />28 1205.05 and allow the owner to quarantine the animal for 10 days. The police department <br />29 has been told that this time period will, in most cases, reveal if the dog is sick. <br />30 ■ Staff did not define potentially dangerous dogs, as the hearing process only refers to <br />31 dangerous dogs. We will depend on State Statute for a variety of definitions rather than <br />32 reiterating State Statute in our ordinance. <br />33 <br />34 Mr. Momson noted the appeals process outlined in Section 1205.11. <br />35 <br />36 Motion by Councilmember Roth, seconded by Councilmember Gray, to hold second reading of <br />37 Ordinance 08 -007, Dangerous Dog Ordinance. <br />38 <br />39 Motion carried unanimously. <br />40 <br />41 VIL REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. <br />42 <br />43 City Manager Mornson reported on the following: <br />44 The next regular City Council meeting is scheduled for Monday, December 8, 2008 <br />45 following the Truth in Taxation Public Hearing. <br />
