He indicated the tower would provide in- 6 building coverage. He commented there are no co- location opportunities within a reasonable 7 distance. He commented he is willing to table the issue and conduct additional research to 8 answer more of the questions 10 Mrs. Rose Minor, Step -By -Step Montessori School, stated she is most concerned with the safety 11 of the children. She asked the Council to consider denying this application. 12 13 Commissioner Heath Galyon, 3516 Skycroft, stated it is insightful to hear the public comments. 14 He explained the recommendation by the Planning Commission was based on the information 15 provided and the recommendations of Staff. He stated it would be contradictory for the City 16 Council to allow antennas in one area and not another, as there are antennas on the water tower 17 with a park below, and on the high school. He commented that if there is passion from the 18 residents, it is beyond just the shopping center, it opens up the argument to cover other towers in 19 the City. Commissioner Galyon stated he felt this is being blown out of proportion. He pointed 20 out everyone uses cell phones and to use them, the technology is needed as are the towers. 21 22 Mayor Pro Tern Horst closed the public hearing at 8:15. 23 24 Mayor Pro Tern Horst clarified the process for a CUP application. 25 26 Councilmember Stille asked if the fee was received. 27 28 City Manager Morrison replied it was received June 15, 2007. 29 30 Mayor Pro Tem Horst explained the three options - Accept, Deny, or Table — available to 31 Council. 32 33 Motion by Councilmember Stille, seconded by Councilmember Gray, to deny Resolution 07- 34 049, a Resolution approving a Conditional Use Permit for T- Mobile for a Monopole Cell Phone 35 Antenna to be located at 2900 Pentagon Drive. 36 37 Councilmember Gray thanked the residents for their comments and the Planning Commission for 38 its work on this issue. He stated he is not sure this application is complete per the City Code. 39 He stated he could not approve this as he feels all the alternatives have not been explored. He 40 stated the terms of the code have not been followed. 41 42 Councilmember Stille commented the code encourages co- location. He stated this location is in 43 the heart of a retail area. He stated code verbiage recommends a third party study. He stated he 44 is against the CUP at this time. 45
