City Council Regular Meeting Minutes <br />June 26, 2007 <br />Page 6 <br />1 65, and 70 and pointed out the purpose of the code is to protect the health, safety, and welfare of <br />2 the public, to protect residential areas from potential adverse effects, to promote shared and or <br />3 co- location of towers, and to ensure towers are compatible with land use. <br />4 <br />5 Mr. Beisner responded to the statements made. He indicated the tower would provide in- <br />6 building coverage. He commented there are no co- location opportunities within a reasonable <br />7 distance. He commented he is willing to table the issue and conduct additional research to <br />8 answer more of the questions <br />10 Mrs. Rose Minor, Step -By -Step Montessori School, stated she is most concerned with the safety <br />11 of the children. She asked the Council to consider denying this application. <br />12 <br />13 Commissioner Heath Galyon, 3516 Skycroft, stated it is insightful to hear the public comments. <br />14 He explained the recommendation by the Planning Commission was based on the information <br />15 provided and the recommendations of Staff. He stated it would be contradictory for the City <br />16 Council to allow antennas in one area and not another, as there are antennas on the water tower <br />17 with a park below, and on the high school. He commented that if there is passion from the <br />18 residents, it is beyond just the shopping center, it opens up the argument to cover other towers in <br />19 the City. Commissioner Galyon stated he felt this is being blown out of proportion. He pointed <br />20 out everyone uses cell phones and to use them, the technology is needed as are the towers. <br />21 <br />22 Mayor Pro Tern Horst closed the public hearing at 8:15. <br />23 <br />24 Mayor Pro Tern Horst clarified the process for a CUP application. <br />25 <br />26 Councilmember Stille asked if the fee was received. <br />27 <br />28 City Manager Morrison replied it was received June 15, 2007. <br />29 <br />30 Mayor Pro Tem Horst explained the three options - Accept, Deny, or Table — available to <br />31 Council. <br />32 <br />33 Motion by Councilmember Stille, seconded by Councilmember Gray, to deny Resolution 07- <br />34 049, a Resolution approving a Conditional Use Permit for T- Mobile for a Monopole Cell Phone <br />35 Antenna to be located at 2900 Pentagon Drive. <br />36 <br />37 Councilmember Gray thanked the residents for their comments and the Planning Commission for <br />38 its work on this issue. He stated he is not sure this application is complete per the City Code. <br />39 He stated he could not approve this as he feels all the alternatives have not been explored. He <br />40 stated the terms of the code have not been followed. <br />41 <br />42 Councilmember Stille commented the code encourages co- location. He stated this location is in <br />43 the heart of a retail area. He stated code verbiage recommends a third party study. He stated he <br />44 is against the CUP at this time. <br />45 <br />
