City Council Regular Meeting Minutes <br />June 27, 2006 <br />Page 5 <br />Councilmember Gray asked if marketing of the units has begun. Mr. Gemar stated they have a <br />list of interested individuals. These individuals will receive a packet of information once the final <br />processes are complete. The first phase is for two buildings and a total of 10 units to the east <br />with construction beginning some time in August or September. The second phase will include <br />the three buildings to the west. <br />7 Mayor Faust asked Mr. Hubmer about the utility plan. Mr. Hubmer reported he has not seen the <br />8 utility plan yet, but he believes there is a condition that Apache Redevelopment LLC must work <br />9 with the City Engineer and the Fire Department to resolve any fire and utility issues. <br />10 <br />11 Motion by Councilmember Stille, seconded by Councilmember Gray, to approve Resolution 06- <br />12 057 to Approval of Silver Lake Village Development Phase IIa. <br />13 Motion carried unanimously. <br />14 <br />15 Councilmember Stille pointed to the staff report which states that if a plat is not recorded in 30 <br />16 days it is null and void. He does not feel 30 days is enough time, as it takes longer at times with <br />17 the review of the plat. He asked City Manager Morrison if it is appropriate to not have the 30 <br />18 days in the resolution. City Manager Morrison believes it is as it is cross referenced with all the <br />19 findings for approval in the resolution. He agrees that 30 days may not be enough time. <br />20 <br />21 Commissioner Galyon pointed out on page 24 in the packet, it states that if recordation does not <br />22 occur within 30 days, the County could reject it. Councilmember Stille would like to take out <br />23 the 30 -day timeframe requirement. <br />24 <br />25 Mayor Faust asked if there have been problems in past. City Manager said issues do happen. He <br />26 suggested the wording say "must submit to the county within 30 days." City Attorney Lindgren <br />27 pointed out that the resolution does include the 30 days because the resolution says "all the <br />28 conditions that are contained in the Planning Commission report", he suggested the City Council <br />29 accept the resolution stating that the revision say "must submit for recording within 30 days" in <br />30 their motion. <br />31 <br />32 Mayor Faust said to enter it into the resolution under "Whereas." <br />33 <br />34 Motion by Councilmember Stille, seconded by Councilmember Gray, to amend the resolution to <br />35 say, "whereas, if submission of plat does not occur within 30 days the approval of the final plat <br />36 becomes null and void. <br />37 Motion carried unanimously. <br />38 <br />39 Motion by Councilmember Thuesen seconded by Councilmember Horst, waiving the second <br />40 reading and approving the final reading to approve Ordinance 2006 -003; new ordinance <br />41 amending Chapter 16 of the City Code being the zoning and land use chapter of the City of St. <br />42 Anthony Village zoning code. <br />43 Motion carried unanimously. <br />44 <br />45 B.
