He indicated that from a precedent in the community, he is <br />curious to see the land plan as it has very similar characteristics as the shopping center. <br /> <br />Commissioner Goodwin asked how many children could be enrolled in the daycare center. <br /> <br />Mrs. Carol Arnes, Lino Lakes, replied the Jack and Jill Daycare has been in Roseville for 35 <br />years and provides care for 125 children ages six months to five years on a daily basis. She <br />mentioned the average age of the client base is 35 to 50 years. She stated that most of the <br />daycare traffic is between 7:15 a.m. and 8:15 a.m. and 4:45 p.m. to 5:30 p.m. <br /> <br />Commissioner Galyon agreed with Vice Chair Jensen and commented on the opening paragraph <br />of the rewrite. <br /> <br />Vice Chair Jensen provided advice and recommendations relative to cycle time on traffic lights <br />in crossing Highway 88 to access Silver Point Park. He suggested that, based on size of floor <br />plan, the applicant anticipate and include potential growth in their study. <br /> <br />Commissioner Jenson asked staff if based on the language change, and if this is the initial <br />concept review, is an additional review required for the public. <br /> <br />Assistant City Manager Moore-Sykes replied that if the change is not significant, a public <br />hearing must still be noticed. She stated it would require only one reading, which could happen <br />at the last City Council meeting in September 2007. She explained that if the Planning <br />Commission recommends approval of the text amendment, a CUP for this specific use would be <br />considered by the Planning Commission. She further explained the text amendment would then <br />go to Council and have a first reading and once text change is approved by City Council they <br />would review the text amendment and the recommendation by the Planning Commission. <br /> <br /> Commissioner Galyon stated the PC due diligence is more in line with the current code and the <br />comprehensive plan. <br /> <br />Vice Chair Jensen requested the City Attorney make his opinion that this is a minor amendment <br />going forward. <br /> <br />Commissioner Galyon suggested staff research the grandfathering issue. <br /> <br />Assistant City Manager Moore-Sykes replied that if the text is changed, and if the business use <br />was conforming at the time of the change, it would become a legal non-conforming use. She <br />explained that if a legal nonconforming business changes more than 50 percent of the current <br />market value or change uses, it would need to be brought into conformance. <br /> <br />Vice Chair Jensen commented it would be prudent to find out what the current ownership would <br />advocate as it relates to the process. <br /> <br /> <br />IX.
