City Council Regular Meeting Minutes <br />March 28 2017 <br />Page 4 <br />Councilmember Gray stated Council has a responsibility to reduce the risk to St. Anthony <br />taxpayers in everything they do so negotiations are being re- opened. He noted the Council values <br />collaborations with other cities. <br />Councilmember Stille stated this comes down to risk. That intersection has 52,000 cars cross it <br />per day so there is a higher degree of risk than in St. Anthony. He is hopeful the contract can be <br />retained but it needs to be fair or equitable. <br />9 Ms. Robinette stated the Police Advisory Committee has met and discussed this issue. She stated <br />10 there are a number of questions and she is speaking for taxpayers of St. Anthony Village. She <br />11 asked what emergency unbudgeted expenses were incurred and has insurance reimbursement <br />12 been received for these expenses. She asked about existing liability and indemnification which <br />13 raised questions because they thought the contract would have an insurance provision for <br />14 services. Ms. Robinette stated they were surprised to hear there were expenses due to the <br />15 shooting in July and there was no insurance built into the contract. Ms. Robinette asked if it was <br />16 possible, rather than having a resolution that shifts the responsibility to Falcon Heights, to have a <br />17 resolution talking about higher insurance costs. Ms. Robinette asked if Falcon Heights would <br />18 need to purchase insurance to insure St. Anthony Police Department and whether that insurance <br />19 could be purchased. She noted the oversight and control is provided by St. Anthony and asked <br />20 how could Falcon Heights purchase insurance for St. Anthony. Ms. Robinette suggested St. <br />21 Anthony would need to purchase additional insurance. <br />22 <br />23 Mayor Faust stated this is the beginning of the negotiation process and it needs to be initialized <br />24 in a formal manner. He does not know the insurance industry but believes insurance can be <br />25 purchased for almost anything. Because of the July 6 incident, there were expenses relating to <br />26 security issues, attacks on the website, large amount of data requests, protests, etc. Falcon <br />27 Heights needs to share in these types of expenses. <br />28 <br />29 City Manager Casey stated the employees are St. Anthony employees. The way the current <br />30 contract reads, St. Anthony assumes all risk and liability. The revenue generated from the <br />31 contracts was not sufficient to cover the risk. The residents of St. Anthony should not have to <br />32 have the burden for things that happen outside the City of St. Anthony. <br />33 <br />34 Mayor Faust stated this resolution has been reviewed by the Dorsey Whitney legal team. <br />35 <br />36 Ms. Sandy Sherman, 4008 Foss Road, #206, stated she has a co- worker that lives in Falcon <br />37 Heights. There are only 6,000 residents in Falcon Heights. She asked how the residents of Falcon <br />38 Heights can be expected to pay any cost for an officer involved shooting in Falcon Heights by a <br />39 St. Anthony Police Officer. She noted there are a number of residents in Falcon Heights that are <br />40 demanding Falcon Heights end the contract with St. Anthony and she finds this resolution is a <br />41 slap in the face for what happened. <br />42 <br />43 Mayor Faust stated both parties have until July 15, 2017, to decide on the contract. He is aware <br />44 there are residents that want the contract ended but everything done needs to be validated. This <br />45 resolution only begins the conversation. He noted there seems to be a disconnect between the <br />46 communities. <br />
