City Council Regular Meeting Minutes <br />April 9, 2019 <br />Page 7 <br />1 City Manager Casey presented the proposed creation of Chapter 98, Small Wireless Facilities <br />2 and changes to Chapter 96 Right -of -way Management, and Chapter 33, Licensure and Permit <br />3 Fees to ensure all chapters coincide. It was noted that first reading was conducted at the March <br />4 26, 2019 City Council meeting. He explained that the next few agenda items were all related and <br />5 suggested talking about them altogether and then working through the approvals individually. <br />6 He noted that the term "small cell" does not describe the size of the facility, but the area that is <br />7 covered. He stated that it is also known as 5G. He explained that this is a brand -new ordinance <br />8 but the right -of -way ordinance needs to be amended as well as the fee schedule for the 5G <br />9 contractors. Staff has not heard any comments from the first reading. He noted that there is a <br />10 new FCC ruling that takes effect on April 15, 2019, so staff is recommending that the City waive <br />11 the second reading and move to the third and final reading. <br />12 <br />13 Motion by Councilmember Randle, seconded by Councilmember Gray, to waive the second <br />14 reading and approve the final reading and adopt Ordinance 2019 -03; an Ordinance to Enact a <br />15 New Chapter 98 of the Code of Ordinances Relating to Small Wireless Facilities, Establishing <br />16 General Standards, a Permitting Process, General Permitting Conditions, and Other <br />17 Requirements. <br />18 <br />19 Motion carried 5 -0. <br />20 <br />21 G. Resolution 19 -034; a Resolution Approving Summary Publication of Ordinance 2019 -03. <br />22 <br />23 Motion by Councilmember Jenson, seconded by Councilmember Stille, to adopt Resolution 19- <br />24 034; a Resolution Approving Summary Publication of Ordinance 2019 -03. <br />25 <br />26 Motion carried 5 -0. <br />27 <br />28 H. Resolution 19 -035; a Resolution Establishing Small Cell Aesthetic Standards. <br />29 <br />30 City Manager Casey reviewed the resolution and noted that as part of the new Small Cell <br />31 Facilities Ordinance there will be a set of aesthetic standards for the equipment. He stated that <br />32 that this will allow the resolution to be amended if and when things change, rather than going <br />33 through the process to amend an ordinance. <br />34 <br />35 Motion by Councilmember Randle, seconded by Councilmember Jenson, to adopt Resolution <br />36 19 -035; a Resolution to Approve Small Wireless Aesthetic Standards. <br />37 <br />38 Motion carried 5 -0. <br />39 <br />40 I. Ordinance 2019 -04; an Ordinance Amending Chapter 33 Establishment of Fee Amounts <br />41 to Add Small Cell Fees. <br />42 <br />43 City Manager Casey noted that staff is recommending waiving the second reading and moving to <br />44 the third reading and adoption. <br />45 <br />
