Agreement No. PW 31-10-21 Road Maintenance Agreement Contract No. _____________ 3 ___ on the east side of the roadway. 2.3.Snow and Ice Control. Maintain the portions of County State Aid Highways listed in Exhibit A to keep the aforesaid portions of roadways reasonably free and clear from snow, ice and debris and undertake proper snow and ice control operations, including salting when necessary. It shall be the City’s responsibility to maintain the through traffic lanes to their full width and such lanes are reasonably free and clear from snow and ice, including application of abrasives and de-icing chemicals when necessary within a reasonable period of time following each winter storm. (Snow and Ice Control on County State Aid Highway listed in Exhibit B is managed under a separate Agreement (PW 42-74-20) with Ramsey County.) 2.4.Changes in County State Aid Highway Lane Mileages. Upon any changes in the lane mileages listed in Exhibit A and B during the term of this Agreement (the “Changes”), the City shall continue to perform its maintenance obligations as stipulated herein. The County shall pay the City for services rendered in accordance with the terms of this Agreement at the unit prices indicated in the Schedule of Costs attached hereto, marked Exhibit C. Such payment for services under this provision shall be prorated for the months in which the Changes occurred. 2.5.Materials. The City shall furnish all labor, materials, supplies, tools and other items necessary for the performance of any and all work provided for in this Agreement. All materials used by the City in the performance of the work shall conform to the requirements of the current Edition of the Minnesota Department of Transportation (MnDOT) "Standard Specifications for Highway Construction" and all amendments and supplements thereto. 3.Obligations and Responsibilities. 3.1.Obligations and Responsibilities. It shall not be the obligation of the City under this Agreement to do any work other than as provided herein which would be construed as extraordinary maintenance, betterment, construction or reconstruction. The duties, obligations and responsibilities imposed upon the City pursuant to this Agreement shall not be construed, nor operate, to create any duty, obligation or liability of the City or the County additional to those that would otherwise be imposed by law to any other person or entity with respect to the maintenance or repair of the County State Aid Highways to be maintained by the City pursuant to this Agreement. 4.Payment. The County will pay for all services performed by the City under this Agreement as follows: 4.1.Payment for Maintenance Services. The County will, for the term of the Agreement, pay the City semi-annually for maintenance services of the County State Aid Highways listed in Exhibit A and B at the unit prices specified in the Exhibit C Schedule of Costs. 51
