City Council Regular Meeting Minutes <br />September 27, 2022 <br />Page 3 <br />B.1 Ordinance 2022-07 – An Ordinance Amending the St. Anthony City Code, by Amending: <br />2 Sections 91.06, 91.56, 91.57 Relating to Keeping and Feeding of Animals; Section 94.15 <br />3 and 96.02 Relating to the Use of the Public Right of Way; Section 96.03 Relating to <br />4 Private Bus and Transit Benches; Section 150.070 – 150.073, Relating to Allowable <br />5 Residential Fence Height and Measurement. <br />6 <br />7 City Manager Yunker reviewed a committee of staff has been reviewing the City Code to <br />8 address various aspects of the language, looking for updating needs, and incorporating staff <br />9 experience with permitting issues, property owner questions, and code enforcement experience. <br />10 A second round of updates to the table-form list of proposed City Code and Zoning Code <br />11 amended language comes before the City Council for consideration. A public hearing was held at <br />12 the August Planning Commission meeting to formally consider the proposed language and <br />13 provide any final edits or recommendations. <br />14 <br />15 Staff and the Planning Commission recommend the City Council adopts the proposed <br />16 amendments to the City Code. <br />17 <br />18 <br />19 Motion by Councilmember Randle, seconded by Councilmember Jenson, to approve Second <br />20 Reading of Ordinance 2022-07 – An Ordinance Amending the St. Anthony City Code, by <br />21 Amending: Sections 91.06, 91.56, 91.57 Relating to Keeping and Feeding of Animals; Section <br />22 94.15 and 96.02 Relating to the Use of the Public Right of Way; Section 96.03 Relating to <br />23 Private Bus and Transit Benches; Section 150.070 – 150.073, Relating to Allowable Residential <br />24 Fence Height and Measurement. <br />25 <br />26 Motion carried 5-0. <br />27 <br />C.28 Resolution 22-065 – Authorizing the Mutual Aid Agreement Between the City of St. <br />29 Anthony Village Public Works and Other Agencies Within the State of Minnesota. <br />30 <br />31 Public Works Director Jeremy Gumke reviewed the purpose of this agreement is to provide a <br />32 process for local units of government to share public works personnel and equipment with <br />33 participating agencies. There is no membership or fixed cost to participate in this public works <br />34 mutual aid pact. <br />35 <br />36 This agreement should not be interpreted as being limited to only use during catastrophic <br />37 situations, rather it may be leveraged for routine circumstances such as training efforts and <br />38 maintenance operations for example. The decision when to request assistance or provide <br />39 assistance is left entirely to the discretion of the requesting and/or sending party. The sending <br />40 party has discretion whether to provide personnel or equipment and can recall such assistance at <br />41 any time. <br />42 <br />43 If resources are requested it should be expected that those costs would be invoiced, however the <br />44 agreement says that “charges may be levied”, so it is the decision of the sending party whether or <br />45 not to invoice the receiving party. The agreement also speaks to responsibility and liability. Each <br />46 party shall be responsible for its own personnel or damaged equipment. Responding personnel
