City Council Regular Meeting Minutes <br />January 10, 2023 <br />Page 4 <br />B. Resolution 23-016 Annrovine Summary Publication for Ordinance 2022-09. <br />City Manager Yunker reviewed this resolution is to approve summary publication for Ordinance <br />2022-09. But, since the Ordinance was not adopted, this will be considered at the next meeting. <br />C. Ordinance 2022-09 — Amending Section 50.16 of Chanter 50 Storm Water and Sanity <br />Sewers. <br />City Manager Yunker reviewed City Staff has worked closely with the Metropolitan Council of <br />Environmental Services (MCES) to establish a Memorandum of Understanding (MOU) related to <br />the Ongoing inflow and infiltration (UI) Program. City Council approved the MOU under <br />Resolution 22-052 at the June 14, 2022 City Council Meeting. <br />Under the terms of the MOU, the City has agreed to adopt and implement ordinances which will <br />require an amendment to the City Code, specifically, Section 50.16 of the Chapter 50 Storm Water <br />and Sanitary Sewers. <br />Mr. Don Jenson was sorry he missed the public hearing. He discovered in looking at online <br />ordinance and written material that came out in the fall newsletters, nowhere in the public <br />information there is no mention of cost or where the problem is with diminishing the infiltration. <br />He handed out written information to the Council. He referred to section H which talks about that <br />someone has to have a certificate of compliance before listing a property for sale. There are 63 <br />properties for sale in St. Anthony — when this ordinance is passed there will be 63 people in <br />violation. There has been no communication to the residents. Some amendments need to be made <br />to the Ordinance. There was no mention on probable costs for doing this to residents. The <br />Ordinance proposal is in conflict with the real estate market. Mr. Jenson stated there is missing <br />data. <br />Mr. Yunker stated those resident's would not be in violation. <br />Councilmember Webster stated the effective date would be adjusted. Assistant City Manager <br />Nicole Miller stated she and Jeremy Gumke did discuss the properties that were on the market. <br />She reviewed the communication plans for this information. Information has also been prepared <br />for realtors and title companies. There is information that will go to the residents with their utility <br />bills next week. <br />Councilmember Jenson asked what is driving the sense of urgency that this be passed this evening. <br />City Manager Yunker stated that is at Council's discretion to act or postpone action. <br />Mayor Stille stated if a resident doesn't want to tear up their yard in the winter, the new buyer <br />could do the repair. The repair doesn't need to be completed before the sale. This is between the <br />buyer and seller as to how this will be handled. <br />Councilmember Webster stated there was a visual inspection done at the most recent street <br />reconstruction. If a house on the street reconstruction already had a visual inspection is another <br />inspection needed. Assistant to the City Manager Miller stated that was discussed and the <br />
