City Council Regular Meeting Minutes <br />September 24, 2024 <br />Page 7 <br />1 <br />2 Councilmember Jenson referred to the environmental elements and the contaminants in the soil <br />3 are seeping into the building. The air handling system would need to be installed. A vapor barrier <br />4 plan would need to be developed and enforced at some point. <br />5 <br />6 Councilmember Randle asked if the applicants were made aware of these contaminants. The <br />7 applicants did not object to the conditions relating to that. <br />8 <br />9 Councilmember Doolan asked about the conditions the applicant is requesting be removed. Mr. <br />10 Yunker stated they remain as staff recommended conditions. <br />11 <br />12 The applicant, Mr. Jaylani Hussein Executive Director of CAIR MN. He reviewed the <br />13 background of the Tibyan Center along with a PowerPoint presentation. A drawing of the first <br />14 floor plan was provided for Council consideration. Phase 1 uses existing rooms as classes and <br />15 Phase 2 develops 17 classes with an estimate of 15 students in each class. Rental space would be <br />16 offered to businesses to generate a tax base for the center for a portion of the center including the <br />17 basement. There has been some vandalism to the building with damages over $20,000. <br />18 <br />19 Mr. Silman Boardmember for Tibyan Center, spoke on behalf of Tibyan Center. He reviewed the <br />20 programs offered by the Center and the outcome of competitions attended by students. <br />21 <br />22 Mr. Hussein reviewed the traffic study data. The amount of traffic for the community center is <br />23 much less than that for a bank. There should not be a lot of traffic for Friday worship as there are <br />24 other mosques in the area. <br />25 <br />26 Mr. Ryan McElrath from Stantec Consulting Services stated they have been involved with the <br />27 property for several years. Stantec has reviewed the environmental conditions of the site. He <br />28 created a memo summarizing their findings and recommendations. The biggest concern are the <br />29 soil vapors at the site for which a radon system is recommended. <br />30 <br />31 Mr. Stan Ross Architect for Tibyan appeared to address any questions. <br />32 <br />33 Mayor Webster noted from the Traffic Study it was indicated the weekday programs would have <br />34 educational programs from 8:00 a.m. – 3:00 p.m. for 30-50 students. Mr. Hussein stated that <br />35 programming is the smallest of the other programs. It is meant to be a homework help type of <br />36 program for online learning. Mayor Webster noted no licensing is necessary and the <br />37 Boardmember Silman indicated if any licensing is required it will be obtained. This is not an <br />38 approved school. They will attend an approved MN Online School. They will be at the center <br />39 while doing the online coursework. The center will provide tutors. Mayor Webster asked about <br />40 the rental of portions of the building which is not reflected in the traffic study. Mr. Hussein <br />41 stated they are not anticipating any rentals would generate a lot of traffic. The actual usage of the <br />42 parking lot is very limited as parents are dropping off and picking up their students. <br />43 <br />44 Councilmember Randle noted in the first application there was no mention of a mosque. Mr. <br />45 Hussein stated for the second application the multi-purpose space will have a mosque as part of <br />46 it. The first application was not clear. More information was provided that could not be executed
