City Council Regular Meeting Minutes <br />September 24, 2024 <br />Page 3 <br />1.1 Resolution 24-063 – Approving a Request for an Amendment to the PUD Zoning District <br />2 for Changes to the Uses and Development Plans in the Kenzie Terrace PUD Overlay <br />3 District. <br />4 <br />5 City Planner Steve Grittman reviewed the City Council is requested to consider the proposed <br />6 amendment to the Planned Unit Development District approval at 2401 Lowry Ave. NE. The <br />7 original PUD District anticipated development of a 76-unit multi-family project, with an <br />8 expectation that the proposed project would be a "market-rate affordable" project based on the <br />9 developer’s description of the project. That project did not go forward. The applicants have <br />10 purchased the subject property and propose to develop the site under an amendment to the PUD, <br />11 incorporating changes to the original proposed land use, and a variety of alterations to the <br />12 building primarily the interior. <br />13 <br />14 The Planning Commission held a public hearing on the request at its regular meeting on August <br />15 20, 2024. Additional information on the hearing and the Planning Commission recommendations <br />16 were provided. The Commission’s recommendation of approval was accompanied by a series of <br />17 conditions, some of which were added by the Commission as a part of its discussion, and <br />18 deleting some conditions proposed by Staff to which the applicants expressed opposition. <br />19 <br />20 Staff’s recommendation is to reincorporate the original staff conditions and add the conditions <br />21 included by the Planning Commission. If acceptable to the Council, action by the Council would <br />22 be as follows: <br />23 Approval of Resolution 24-063 approving an amendment to the Planned Unit <br />24 Development District at 2401 Lowry Avenue NE, based on the findings of fact in the staff <br />25 report for this date, and incorporating the conditions of approval in said resolution. <br />26 <br />27 Mr. Grittman reviewed the project background and timeline in detail providing summaries of the <br />28 June 2024, July 2024, and August 2024 Planning Commission Meetings. Ultimately, the <br />29 Planning Commission recommended approval of the PUD amendment, with changed conditions <br />30 from those of Staff. Staff continues to recommend incorporation of the original conditions as <br />31 with any PUD, flexibility in site use and other aspects of development from the City’s standard <br />32 zoning requirements is to be offset by site improvements and project amenities that result in <br />33 project that furthers the City’s land use goals and objectives. Without the site improvements <br />34 suggested by Staff (and originally conceptually offered by the applicants), the site would remain <br />35 in a condition that is not consistent with the City’s standards. <br />36 <br />37 Mr. Grittman reviewed Staff’s Recommendations. In the initial application, the issue for the City <br />38 was whether the PUD zoning and the Development Agreement governing the land use on the site <br />39 should be amended to incorporate a use that was not contemplated by the original PUD approval. <br />40 <br />41 The amended application expands the proposed use of the site, and – while it varies from the <br />42 original PUD – the principal use is within the realm of the uses written into the Kenzie Terrace <br />43 PUD District. Staff believes that the proposed land uses on the site are consistent with the <br />44 underlying land use planning for this area and subject to site plan notes and appropriate <br />45 amendments to the zoning district, allowable under the PUD Zoning. <br />46
