City Council Regular Meeting Minutes <br />April 22, 2025 <br />Page 9 <br />1 <br />2 Mayor Webster asked Mr. Sonterre about the abatement process. Mr. Sonterre stated the City <br />3 Attorney legally notices the resident; they will be given 30 days to comply while the process of <br />4 establishing a civil abatement date in the court. If someone becomes compliant, the court date <br />5 will be cancelled. If they do not, the Court will provide an order for the City to go into the <br />6 property to do the abatement. Mayor Webster asked if the City needs to hire a company to <br />7 remove items to abate who handles that cost. Mr. Yunker stated that it needs to be researched. <br />8 <br />9 Councilmember Doolan asked if there is a start-over period, and Mr. Sonterre stated he cannot <br />10 answer that question. <br />11 <br />12 Motion by Councilmember Elnagdy, seconded by Councilmember Randle, to approve the <br />13 abatement of violations process on the property located at 3004 31st Avenue as listed. <br />14 <br />15 Motion carried 5-0. <br />16 <br />b.17 3208 Skycroft Drive <br />18 <br />19 Mr. Sonterre noted that since 2020, City Staff has made numerous attempts through in-person, <br />20 educational materials, violation notices, and direct mail to encourage Mr. John Kelly, who <br />21 resides at 3208 Skycroft Drive in St. Anthony, to address the violations. Many of the violations <br />22 started as complaints from his neighbors, while others were proactive actions from code <br />23 enforcement inspectors. <br />24 <br />25 The violations were documented both in written form as well as numerous photos that have been <br />26 taken over the past several years. The photos and observation dates, and efforts were provided <br />27 for Council review. The common violations were vehicles in inoperable condition, expired <br />28 registrations, a significant amount of household items and debris stored both outside on the front <br />29 drive as well as in the vehicles themselves, as well as significant housing maintenance code <br />30 issues. <br />31 <br />32 Various areas that code compliance focuses on are the health, safety, and welfare of both the <br />33 residents and their properties. Keeping significant debris in areas for long periods can promote <br />34 rodent harborage. This can have far-reaching consequences for the neighboring properties from <br />35 both a safety standpoint as well as an overall negative impact on their residences. This large <br />36 amount of debris does detract from the other well-maintained properties on this street. <br />37 <br />38 The amount of debris and household items on this property has been changing over the years. <br />39 <br />40 Staff is asking that the following violations be abated at the property: <br />41 Inoperable vehicle with expired tabs and used as a storage vessel, plate RFJ-905. <br />42 Vehicle used as a storage vessel, collector plate 025719. <br />43 Commercial vehicles do not meet the parking requirements in an R-1 zoned property, <br />44 plate LM8407. <br />45 Any household items/debris stored outside on the front yard, including the driveway, <br />46 which Staff will work with him to identify the specific items. <br />11
