City Council Regular Meeting Minutes <br />May 13, 2025 <br />Page 9 <br />1 their own property, and if they cause damage to another’s property, they are required to <br />2 remediate the damage. <br />3 <br />4 Councilmember Elnagdy stated that there are contractors doing work and damaging property. <br />5 Mr. Grittman stated they generally secure the threat to the City's costs. <br />6 <br />7 Councilmember Doolan expressed concern about felling some very large trees. Mr. Grittman <br />8 stated they are required to stay on their own property unless they have permission to cross that <br />9 line. Mr. Yunker stated there has been no damage to neighboring properties from recent <br />10 developments within the City. <br />11 <br />12 Councilmember Elnagdy asked how long construction would take, and Mr. Vang stated <br />13 approximately 10 months. <br />14 <br />15 Mayor Webster noted that it should be anticipated that an emergency vehicle will visit this <br />16 facility at least once a week. She asked if a condition could be added that two of the parking <br />17 spots be reserved for emergency vehicles. Fire Chief Diaz stated he feels comfortable with the <br />18 plan and does not see the necessity to have reserved parking spots for emergency vehicles. Mr. <br />19 Tibrock indicated the no-parking area that could be used by emergency vehicles. <br />20 <br />21 Councilmember Elnagdy asked about the parking situation for the townhomes to the north, and <br />22 Mr. Grittman stated that their primary parking is in the garages, and there is room for vehicles <br />23 outside the garages for each unit. Councilmember Elnagdy asked if it were changed from <br />24 assisted living to multi-family, who would bear the cost of the changes? Mr. Grittman stated that <br />25 it would be negotiated between the seller and the new buyer. <br />26 <br />27 Councilmember Doolan believes there are frequent visitors to assisted living facilities, but she <br />28 appreciates the research that the applicant has done. There will be 16 parking spaces, and she <br />29 questioned if this would be adequate when staff are changing for shifts. The two spots are striped <br />30 as no parking to allow for vehicles to turn around. Councilmember Doolan asked about the green <br />31 space between the street emergency zone and the building is green space. Mr. Tibrock stated that <br />32 it would be where the sign is located. <br />33 <br />34 Motion by Councilmember Jenson, seconded by Councilmember Doolan, to Resolution 25-037 - <br />35 Approving a Request for a Conditional Use Permit for a 34-unit Assisted Living Facility as well <br />36 as Variances from the Side Yard Setback in an R-4 Zoning District, from Parking Requirements <br />37 in an R-4 Zoning District, and from the Impervious Surface Maximum in an R-4 Zoning District <br />38 with 17 conditions noted. <br />39 <br />40 Councilmember Doolan requested to talk through the three variances. She feels comfortable with <br />41 the variance for the impervious surface with the BMP being constructed. For the variance for the <br />42 setback, she does not feel this is unreasonable. She is challenged with the variance on parking for <br />43 the functionality and effectiveness for staff. She believes the conditions are good strategies for <br />44 dealing with concerns. She does not care for the idea of putting people onto the street for <br />45 parking. <br />46
