3.REGIONAL IMPACT ACKNOWLEDGMENT <br />The Society acknowledges that the State Fair creates a regional public safety impact affecting <br />surrounding jurisdictions, including areas served by SAPD, and that SAPD’s enhanced <br />deployment is directly attributable to the Fair. <br />4.SAPD RESPONSIBILITIES <br />During the Term, SAPD will provide enhanced law enforcement services including patrol, traffic <br />management, parking enforcement, investigations, and administrative support within it’s current <br />jurisdictional boundaries of the City of Falcon Heights. <br />5.LIMITATIONS <br />SAPD may reassign resources as necessary to maintain adequate protection within its jurisdiction. <br />SAPD personnel remain under SAPD command and control. The manner and standards of <br />performance, the discipline of law enforcement officers, and other matters incident to the <br />provision of services under this Agreement lies solely within the control of SAPD. In the <br />event of a dispute between the parties as to the extent of the duties and functions to be <br />rendered hereunder, or the level or manner of performance of such service, the determination <br />thereof made by SAPD shall be final and conclusive as between the parties hereto, <br />6.PAYMENT AND COMPENSATION <br />The Society agrees to reimburse SAPD. <br />Total reimbursement shall not exceed $49,812.84 <br />SAPD will submit an invoice following completion of services. Payment is due within 30 days. <br />7.LIABILITY <br />1. Pursuant to the provisions of Minnesota Statutes § 471.59, subd. la(a), except for <br />liability, claims, injury, damages, costs, or expenses resulting from the sole <br />negligence and/or intentional, willful, or wanton acts of SAPD employees, officials, <br />representatives, and agents, the Society agrees to be responsible for the acts or <br />omissions of SAPD and its employees, officials, representatives, and agents in <br />33
