the City transfers the ADU license to the new <br />owner upon sale. <br />seller and buyer may arrange for <br />a transfer of the ADU license. <br />(c)No parcel may contain more than one ADU <br />per single family detached dwelling. <br />(d)Any ADU occupied by a renter shall require a <br />rental license, for which the City shall record <br />as a second class of single family rental <br />licenses. ADUs occupied by a relative of the <br />owner will require an ADU license, <br />notwithstanding the exemption to rental <br />licensing for qualified relatives. <br />The City will monitor total <br />numbers of ADU rental licenses <br />as a separate class of license. <br />(e)An ADU shall not be included in the eligible <br />number of single family dwelling rental <br />licenses in the City’s maximum rental license <br />caps, either for total or neighborhood-level <br />totals. <br />ADUs will not be subject to the <br />overall rental cap – they do not <br />infringe on the number of homes <br />available for owner occupancy. <br />(f)Short-term rentals shall not be allowed to <br />occupy ADUs. <br />This regulation furthers the City’s <br />intent to severely limit STRs, <br />since new ADUs are not able to <br />meet the “pre-existing” STR <br />license requirement in current <br />code. <br />(3)Operational Requirements <br />(a)Structure Requirement. Any ADU shall be <br />required to be part of, or attached to, an <br />existing principal dwelling or a detached <br />structure. No freestanding ADUs, nor any <br />attachment to or occupancy of any other <br />accessory building shall be allowed. <br />This regulation is intended to <br />limit lot coverage, and further <br />avoid the propagation of <br />additional accessory buildings on <br />the City’s residential parcels. <br />Staff notes that the current <br />Accessory Building height <br />limitation is 15 feet measured to <br />the average height of the roof, <br />and 20 feet to the peak. <br />(b)Utility Connections. An ADU shall be <br />connected to City sanitary sewer and water <br />supplies through a connection to the principal <br />dwelling. No separate connections to City <br />sewer or water mains shall be permitted. <br />This limitation avoids double <br />metering on single family parcels <br />at the recommendation of City <br />public works staff. <br />(c)Public Service Capacity.
