Section Draft Ordinance Text Staff Notes and Comments <br />§154.007 DEFINITIONS (zoning) <br />ACCESSORY DWELLING UNIT (ADU). A <br />secondary dwelling unit, subordinate to the <br />principal dwelling on the parcel, occupied as a <br />separate dwelling with its own kitchen, <br />sanitation (bathroom), and sleeping area, along <br />with a separate exterior entrance to the <br />outdoors. <br />§154.176 ACCESSORY BUILDINGS <br />(I)Accessory Dwelling Units (ADUs)New Subsection <br />(1)Purpose and Intent <br />This Section establishes regulations relating to <br />the establishment and operation of Accessory <br />Dwelling Units (ADUs) on properties occupied by <br />a single family home. The purpose of these <br />regulations is the accommodation of additional <br />density in limited scope, and that are designed <br />and operated in ways that have the least <br />impacts on existing single family neighborhoods. <br />ADUs shall only be permitted on parcels that <br />meet all other land use regulations applicable to <br />any particular property, and as expressly <br />accessory uses, shall not be presumed to be <br />allowed on any parcel which is not otherwise in <br />full compliance with all other zoning, building, <br />fire, and other requirements. <br />General Information on the <br />reason and initial factors for <br />considering ADUs. <br />(2)Administrative Requirements <br />(a)ADUs may be located only on parcels occupied <br />by one single family detached dwelling in an R-1 <br />or R-1A zoning district. <br />(b)Any ADU shall be required to be located on a <br />parcel on which either the principal dwelling or <br />the ADU is occupied by the owner of the <br />property as the owner’s homestead. <br />Note that when an owner of <br />property sells and converts <br />the parcel to a licensed rental <br />unit, a licensed ADU will need <br />to have its rental license <br />terminated. <br />(c)No parcel may contain more than one ADU per <br />single family detached dwelling. <br />11
