(d)Any ADU occupied by a renter shall require a <br />rental license, for which the City shall record as <br />a second class of single family rental licenses. <br />The City will monitor total <br />numbers of ADU rental <br />licenses as a separate class of <br />license. <br />(e)An ADU shall not be included in the eligible <br />number of single family dwelling rental licenses <br />in the City’s maximum rental license caps, either <br />for total or neighborhood-level totals. <br />ADUs will not be subject to <br />the overall rental cap – they <br />do not infringe on the <br />number of homes available <br />for owner occupancy. <br />(f)Short-term rentals shall not be allowed to <br />occupy ADUs. <br />This regulation furthers the <br />City’s intent to severely limit <br />STRs, since new ADUs are not <br />able to meet the “pre- <br />existing” STR license <br />requirement in current code. <br />(3)Operational Requirements <br />(a)Structure Requirement. Any ADU shall be <br />required to be part of, or attached to, an <br />existing principal dwelling or a detached garage. <br />No freestanding ADUs, nor any attachment to or <br />occupancy of any other accessory building shall <br />be allowed. <br />This regulation is intended to <br />limit lot coverage, and <br />further avoid the <br />propagation of additional <br />accessory buildings on the <br />City’s residential parcels. <br />Staff notes that the current <br />Accessory Building height <br />limitation is 15 feet <br />measured to the average <br />height of the roof, and 20 <br />feet to the peak. <br />(b)Utility Connections. An ADU shall be connected <br />to City sanitary sewer and water supplies <br />through a connection to the principal dwelling. <br />No separate connections to City sewer or water <br />mains shall be permitted. <br />This limitation avoids double <br />metering on single family <br />parcels at the <br />recommendation of City <br />public works staff. <br />(c)Public Service Capacity. The City reserves the <br />right to cap ADU licensing in the event public <br />services (streets, sanitary sewer, water, parks, or <br />others) in any area of the City approach the <br />City’s service capacities. <br />Currently, there are no <br />limitations to public utility <br />capacities. Engineering staff <br />notes that ADUs function <br />essentially as additional <br />bedrooms on single family <br />homes, rather than full- <br />capacity dwellings. <br />12
