45 <br />CITY OF ST. ANTHONY VILLAGE <br />ORDINANCE 2009-006 <br />HOUSEKEEPING LANGUAGE TO ALLOW BACKGROUND CHECKS <br />TITLE III: ADMINISTRATION <br />Chapter 32. City Organizations <br />32.43 POLICE DEPARTMENT. <br />(A) Responsibilities. The Police Department will have the duties and responsibilities given <br />in accordance with the Constitutions and laws of tho United States and the State of Minnesota, <br />this code and other official acts of the city. The Police Department, under the direction of the <br />Chief of Police, is charged with the protection of all persons and property within the corporate <br />limits of the city, and the other areas as agreed upon by the City Council or required by law. The <br />Police Department will be responsible for prevention of crimes, accidents, and civil disorders, <br />control of traffic, and general enforcement of this code and applicable statutory laws. As such, <br />man the request of the City Mana e� r or designee the Police Department shall provide certain <br />criminal histoly data through the Minnesota Bureau of Criminal Apprehension BCA). The data <br />to be provided must only be about finalists or City positions o em loyment provided the City <br />Mana erg�.or designee has obtained the required written consent of the finalists before reAuestiniz <br />the data, with the understanding that the applicant's failure to provide consent will disquali.y the <br />applicant from the prospective position. <br />TITLE XI: BUSINESS REGULATIONS <br />Chapter 111. Licenses, Permits and the Like <br />111.256 APPLICATION VERIFICATION (Second Hand Dealers). <br />All applicants shall be referred to the Police Department for verification and investigation <br />of the facts set forth in the application. Within 60 days after receipt of a complete application, the <br />Police Department shall make a written report and recommendations to the City Council as to <br />issuance or non -issuance of the license. The City Council may order and conduct the additional <br />investigation as it deems necessary. The City Manager may also request that the Police <br />Department shall provide certain criminal histou data contained at the Minnesota Bureau o <br />Criminal Apprehension for the investigation of an applicant's character and verification of the <br />acts as set orth in the application. If additional investigation is necessary, the applicant shall <br />pay the City for cost of the additional investigation.
