Victor Gardens North Village 71 Addition <br />Page 2 <br />On July 5, 2005, the City Council approved a final plat for the eastern 82 townhomes and <br />an outlot of the subject parcels for the remaining 104 townhomes. <br />On April 21, 2008, the City Council approved a preliminary plat and PUD amendment <br />for the subject parcel to modify the townhome product design and reduce the number of <br />units to 72. The approved products were 8 and 10 unit townhomes known as the Vantage <br />and 4 unit townhomes known as the Courtyard townhomes. <br />On June 16, 2008, the City Council approved the final plat for the Courtyard townhomes, <br />8 multi -family units (two 4-plex buildings). Only one of the buildings was built. This <br />leaves a lot platted for another Courtyard townhome and the two remaining outlots which <br />are the subject parcels. <br />3. CONTEXT: <br />A. Surrounding Land Use and Zoning <br />The property to the south, across Rosemary Way, is part of this development (Victor <br />Gardens North Village) and is developed with Ideal Credit Union, Kwik Trip and a Park <br />Dental. The property to the west is farmland in the City of Lino Lakes. The property to <br />the east is a previously approved phase of townhomes in Victor Gardens North. The <br />property to the north is zoned Agriculture and consists of 10 -acre residential parcels. <br />B. Natural Site Characteristics <br />The site is currently vacant and was platted as an outlots as part of a previous addition in <br />the Victor Gardens development. The site contains multiple wetlands and was previously <br />graded in preparation of development. <br />4. ANALYSIS: <br />A. Level of City Discretion in Decision -Making <br />The City has a relatively high level of discretion in approving PUD amendments. A PUD <br />must be consistent with the City's Comprehensive Plan. The City may impose <br />reasonable requirements in a PUD not otherwise required if the City deems it necessary <br />to promote the general health, safety and welfare of the community and surrounding area. <br />The City's discretion in approving or denying a preliminary plat is limited to whether or <br />not the proposed plat meets the standards outlined in the Comprehensive Land Use <br />Regulations. If it meets these standards, the City must approve the preliminary plat. <br />B. Consistency with Ordinance Standards <br />The Victor Gardens PUD is a compact, mixed-use development consisting of residential, <br />retail, office, and institutional uses.
