Motion carried. <br />Approve Variance for Accessory Structure Size for 15220 Everton Ave. — Triemert <br />The applicant is requesting a variance from the accessory structure size requirements to allow a <br />total of 5,688 square feet of accessory structures where 3,600 is allowed by ordinance. At their <br />December 11, 2008 meeting the Board considered the request at a public hearing. It was in <br />staff's opinion that the conditions to approve the variance requests were not met. Staff <br />recommended to the Board denial of the variance request for an additional 480 square feet of <br />accessory structure and approval of the request to allow for the 768 square foot addition that has <br />been constructed for a total of 5,208 square feet of accessory structures. The Board <br />recommended approval of a total of 5,688 square feet of accessory structures to the City Council <br />by a vote of 2-1. Associate Planner Rachel Simone presented this to the Council with a <br />PowerPoint presentation. Councilmember Haas said he felt the request did not meet all the <br />requirements for the granting of a variance. <br />Petryk made motion, Weidt seconded, to approve RESOLUTION 2009-2 APPROVING A <br />VARIANCE TO ALLOW A TOTAL OF 5,688 SQUARE FEET OF ACCESSORY <br />BUILDINGS FOR THE PROPERTY LOCATED AT 15220 EVERTON AVENUE NORTH. <br />Ayes: Petryk, Weidt, Klein, Miron <br />Nay: Haas <br />Motion carried. <br />Staff was directed to add to the 2009 City Council Goal Setting agenda a discussion on revisions <br />to the ordinance regarding permitted size of accessory storage in rural areas. <br />Discussion Regarding Junk Vehicles at the Northeast Corner of 130th St. & Fenway Ave. <br />Charles Lowell is the owner of the property located at the corner of 130th St. and Fenway Ave. <br />The City has received several complaints of junk vehicles, trailers, and other equipment located <br />on his property. Staff sent several notices over the past few months. On October 10, 2008 staff <br />sent Mr. Lowell a notice to remove the equipment by November 1, 2008. When he did not <br />comply by the listed date, staff contacted Mr. Lowell via telephone and talked with him to work <br />out timeline when he would have the items removed. Mr. Lowell continuously promised staff <br />that he would have the vehicles removed. Little to nothing has been done to resolve this matter <br />to date. Staff has spoken with several property owners that are very upset that no action has been <br />taken to remove the junk vehicles and items <br />Miron made motion, Klein seconded, to send a certified letter to the property owner requiring <br />him to remove the materials within ten days or the City will begin legal action. <br />All ayes.
