Hugo City Council Minutes for October 5, 2009 <br />Page 5 of 6 <br />Approve Variances for Dan and Ranell Tennyson at 12582 Ingersoll Avenue North <br />Dan and Ranell Tennyson are requesting variances to allow the construction of a 1,152 square <br />foot addition to their existing home located at 12582 Ingersoll Avenue North. The first variance <br />request is to allow the addition to be built 36 feet from the front property line where 40 feet is <br />required by ordinance. The second variance request is to allow the addition to be built 31 feet <br />from the rear property line where 50 feet is required by ordinance. The final variance request is <br />from the shoreland setback requirements to allow the addition to be 21 feet from the ordinary <br />high water (OHW) mark of Sunset Lake where 100 feet is required. At its September 24, 2009, <br />meeting the Board of Zoning held a public hearing on the variance requests. There was no one <br />who spoke at the public hearing except the applicant. The Board asked questions about what the <br />addition would include and the applicant stated that a portion of it would be an attached garage. <br />The Board unanimously recommended to the City Council approval of the variance requests. <br />Adoption of the Consent Agenda approved RESOLUTION 2009-34 APPROVING <br />VARIANCES FOR DANIEL AND RANELL TENNYSON IN THE RURAL RESIDENTIAL <br />ZONING DISTRICT ON PROPERTY LOCATED AT 12582 INGERSOLL AVENUE NORTH. <br />Approve Revisions to Development Agreement for Inclusion of Safe Room Option <br />At its September 24, 2009 meeting, the Hugo City Council listened to a presentation from <br />Community Development Director Bryan Bear who shared with Council issues related to a <br />request for the option for construction of safe rooms in homes. This request was from residents <br />living in the Water's Edge neighborhood who experienced the May 25, 2008 tornado disaster. <br />Council agreed that it should not mandate the construction of safe rooms but should include them <br />as an option to be presented to new home owners. Council directed staff to prepare revisions to <br />the City's standard development agreement for the inclusion of a safe room option. KSTP <br />Channel 5 News Crew was in attendance along with Betty Zuettlel, 5164 1581 Street North, who <br />initially brought this issue to Council. The Mayor and Community Development Director Bryan <br />Bear provided a recap of previous discussions on safe rooms, and the Mayor thanked Betty for <br />raising this issue to the Council. Adoption of the Consent Agenda approved revisions to the City <br />of Hugo's standard development agreement for the inclusion of a safe room option with the <br />construction of new homes in new developments. <br />Approve Authorization to Hold Public Hearing on Ordinance for Interim Use Permits, <br />Special Event Permits, Transient Merchants and Peddlers <br />The City of Hugo has formed an Ordinance Review Committee (ORC) to update several areas of <br />the Municipal Code. There are members of the Planning Commission and City Council on the <br />ORC. On August 3, 2009, the City Council authorized staff to have the ORC review the interim <br />use permits, special event permits, transient merchants, and peddlers ordinance. Over the past <br />two months the ORC has been working on creating and updating the ordinances. Staff is looking <br />for authorization from the Council to schedule a public hearing at the Planning Commission on <br />the ordinances. Adoption of the Consent Agenda approved scheduling a public hearing on <br />interim use permits, special event permits, transient merchants, and peddlers ordinance. <br />
