Adoption of the Consent Agenda approved the low bid quotes from Olson's <br />Sewer & Excavating in the amount of $17,181.98 for the 2009 Ditch Maintenance and a quote in <br />the amount of $32,661.70 for the 2010 Ditch Maintenance. <br />Approve Ordinance Establishing 2010 City Fee Schedule <br />Each year in December Council, upon recommendation from the Finance Department, adopts a <br />new fee schedule that incorporates any necessary adjustment in fees for the upcoming year. <br />Finance Director Ron Otkin worked with City staff to make adjustments to the 2010 City fee <br />schedule. Adoption of the Consent Agenda approved ORDINANCE 2009-438 <br />AUTHORIZING ESTABLISHMENT OF FEES, RATES AND CHARGES. <br />Approve Resolution Certifying Delinquent Utility Accounts <br />Annually, the Finance Department reviews all delinquent utility bills, which are the result of <br />nonpayment or underpayment of water and sewer utility bills. In accordance with City <br />ordinance, Council is required to adopt a resolution to certify delinquent utility bills to the <br />property tax rolls. Adoption of the Consent Agenda approved RESOLUTION 2009-48 <br />DECLARING UNPAID UTILITY BILLS BE PLACED ON THE PROPERTY TAX ROLLS. <br />Public Hearing on Renewal of Interim Use Permit for Home Occupation - Modrow <br />Joseph Modrow, 7180 177th Street North, has applied for renewal of his Interim Use Permit to <br />operate a sewer and drain cleaning business from his home. At its November 5, 2007 meeting <br />the City Council approved the home occupation interim use permit for the property. The home <br />occupation ordinance states after two years the interim use permit shall be reviewed for renewal <br />if the applicant would like to continue the home occupation. A public hearing is required for the <br />renewal because the applicant is in violation of two conditions in the Interim Use Permit. <br />Associate Planner Rachel Simone explained the applicant was to remove, within one year of his <br />initial approval, a semi -cab that had been used in the business. There was also an extra sewer <br />pump truck being stored on the property. The applicant Joe Modrow stated he was trying to sell <br />the vehicles. City code allows for two unlicensed vehicles to be stored on a property per the <br />Nuisance Ordinance, and the vehicles on the Modrow parcel could be considered junk vehicles. <br />Mayor Miron opened the public hearing. <br />John Olson, 7097 177th Street North, said Joe has been respectful of the residential <br />neighborhood, but he did not want the business to grow. <br />There were no other comments, and Mayor Miron closed the public hearing. <br />Weidt made motion, Klein seconded, to approve RESOLUTION 2009-49 APPROVING THE <br />RENEWAL OF AN INTERIM USE PERMIT TO ALLOW FOR THE OPERATION OF A <br />HOME OCCUPATION AS AN ACCESSORY USE ON THE PROPERTY LOCATED AT <br />7180 177TH STREET NORTH. <br />All Ayes. Motion carried. <br />
