Hugo City Council Minutes for December 15, 2008 <br />Page 9 of 11 <br />Miron made motion, Granger seconded to approve RESOLUTION 2008-62 APPROVING PLANS <br />AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS FOR THE FONDANT <br />AVE., FOXHILL AVE., FRANCESCA AVE., FREELAND AVE., GENEVA AVE., LOWER 147TH <br />STREET N., 148TH STREET N., 150TH STREET N., ROADWAY, DRAINAGE, AND UTILITY <br />IMPROVEMENTS. <br />Ayes: Haas, Puleo, Granger, Petryk, Miron <br />Nays: None <br />Motion carried. <br />Discussion on December 5, 2008 Meeting with MN DOT on Traffic Improvements to TH 61 and <br />147th Street Intersection <br />On Friday, December 5, 2008, Community Development Director Bryan Bear and City Engineer Jay <br />Kennedy met with MN DOT officials to discuss improvements to the TH61 and147th Street <br />intersection. As Council is aware, the cooperative agreement has been approved by MN DOT to provide <br />funding for improvements to the intersection which may include new signal lights. City Engineer Jay <br />Kennedy provided Council with an update. MN DOT has agreed to approve the installation of the <br />traffic signal at TH61 and 147th Street with the City's approval on expanding the project. <br />Miron made motion, Haas seconded, to direct staff to continue to work with MN DOT to finalize the <br />added scope and associated cost implications, and to review the project funding and present it to the <br />Council at their January 5, 2009 meeting. <br />All Ayes: Motion carried. <br />Discussion on Jeremy L'Allier Home Occupation Violation at 7130 177th Street North <br />On June 16, 2008 the City Council approved a transition plan for Mr. L'Allier to remove his business <br />from the property prior to December 1, 2008. Staff met with him on November 18, 2008. At the meeting <br />he explained that he had failed to find an alternate location for his business that exactly meets his needs. <br />The primary reason he cited for failing to relocate his business was due to the poor state of the economy. <br />At the meeting he also requested more time to remove the business and talked about making another <br />application for an interim use permit for a home occupation. Staff assured him that despite the condition <br />of the economy there is a significant amount of industrial land and industrial buildings available in this <br />region that will accommodate his use. Staff also offered some assistance in helping him find a location <br />in Hugo, and staff informed him of several sites that were available. Staff completed an inspection of the <br />property on December 2, 2008 and found that nothing had changed on the property. Staff then called Mr. <br />L'Allier and he stated that he has not removed the business from the property, but has a purchase <br />agreement for an office warehouse in the Bald Eagle Industrial Park. <br />Miron made motion, Haas seconded, to authorize staff to undertake whatever legal action necessary to <br />remove the business from the property. <br />All Ayes. Motion carried. <br />
