Resolution 2003-35 <br />f Page 2 <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCEL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Emmerich Development Corporation for a PUD general plan, subject to the <br />following conditions: <br />1. A preliminary plat is approved to allow the creation of 175 single family lots 5 <br />outlots, in accordance with the plans and application received by the City on May 6, <br />2003, except as amended by this resolution. <br />2. Approval is contingent upon City Council approval of the requested comprehensive <br />plan amendment, rezoning and preliminary plats. <br />3. The PUD general plan is approved based on the finding that the proposed project is <br />consistent with the City's Comprehensive Plan. <br />4. Development standards for the PUD shall be as indicated on the plans dated May 6, <br />2003, except as amended by this resolution. <br />5. The applicant shall provide copies of the HOA documents/covenants for City review. <br />6. The applicant shall develop and implement architectural review and design guidelines <br />for all residential buildings. The guidelines must be submitted for City review and <br />approval. <br />7. The typical lot detail should be revised to reflect the requested and approved setback <br />requirements. <br />8. All platted residential lots shall comply with the following setbacks: <br />Minimum lot width <br />80 feet <br />Minimum lot width for detached <br />townhomes in Diamond Point East <br />60 feet <br />Minimum front yard setbacks <br />25 feet <br />Minimum side yard setbacks <br />10 feet <br />Minimum rear yard setbacks <br />30 feet <br />Setback around the perimeter of the site <br />(exterior property lines) <br />3 e <br />Setback from OHW of Egg Lake <br />75 feet <br />Setback from OHW of Rice Lake <br />150 feet <br />Maximum Impervious Surface Area <br />25% <br />Architectural and Design standards <br />9. The developer shall submit a design palette for entire project for City review and <br />approval. The palette shall include colors for siding, shakes, shutters, shingles, brick <br />
