Resolution 2001- 57 <br />Page 4 <br />east and west of the development site, the applicant shall not pave the street at this <br />time; but rather, put money in escrow for the future upgrade. The escrow shall be <br />paid prior to platting the final phase, or December 31, 2004, whichever occurs first. <br />19. The Cities of Hugo and Lino Lakes have formally vacated the road pending approval <br />of a preliminary and final plat. To insure that Elmcrest remains open until the new <br />north/south road is constructed, the applicant shall dedicate a temporary roadway <br />easement over Ehncrest Avenue. <br />20. This development is dependent upon a joint powers agreement between the City of <br />Hugo and the City of Lino Lakes for the provision of municipal water service to the <br />development. The joint powers agreement must be signed prior to recording the final <br />plat. <br />21. Sidewalks shall be required along both sides of all public streets. At the time of final <br />plat review, the City may require sidewalk easements or additional drainage and <br />utility easements to insure adequate area for utility installation and the landscape <br />plantings. <br />22. Cross access and maintenance agreements shall be recorded with the final plat for all <br />shared private driveways or streets. <br />23. The development shall comply with the Fire Chief s requirements regarding fire flow <br />calculations, the location of fire hydrants, fire department connections, and fire lane <br />signage. <br />24. The plat shall comply with the City's street naming system. <br />Parks/Open Space <br />25. The plat includes 3.41 acres of parkland that the City will accept. <br />26. The applicant is responsible for the improvement of the parkland, which at a <br />minimum shall include seed/sod and trees as shown on the landscape plan. <br />27. All other improvements on the City parkland shall be subject to the review and <br />approval by the Parks Commission. <br />28. Approved improvements to the City parkland will be credited against future park <br />dedication/fees for subsequent phases of the development. <br />29. The applicant shall be responsible for all parkland maintenance for a period of five <br />years, or until the project is complete, whichever occurs first. After this period of <br />time, the City will assume normal park maintenance responsibilities for the City <br />parkland. <br />30. The applicant shall incorporate the park maintenance responsibilities into the <br />homeowners association documents. <br />
