City Council meeting of August 6, 2007 <br />Page 4 <br />APPROVE RECOMMENDATION FROM PLANNING COMMISSION FOR AMENDMENT <br />TO CUP FOR BALD EAGLE SPORTSMAN ASSOCIATION <br />Council member Frank Puleo stated that he is a member of BESA and will not be participating in this <br />discussion or vote on the issue. The Bald Eagle Sportsman Association, 6557125' Street North, applied <br />for an amended Special Use Permit (SUP) to make it consistent with the recently adopted state law. At <br />its June 14, 2007 meeting, the Planning Commission held a public hearing, which was attended by <br />several residents and members of the Club. The PC voted 4 to 2 to recommend approval of an amended <br />permit. At its July 16, 2007 meeting, Council considered an amendment to the CUP for the Bald Eagle <br />Sportsman Association, and after discussion, agreed to table the issue until its next regularly scheduled <br />meeting. City staff was directed to schedule a meeting with Mayor Fran Miron and Council member <br />Chuck Haas, as well as members of the gun club and neighbors, to discuss issues related to the CUP. At <br />the meeting, Mayor Miron suggested that a resolution be drafted that encourages the gun club to operate <br />in a responsible fashion. Said draft resolution was submitted to Council for consideration and approval. <br />CD Director Bryan Bear provided a PowerPoint presentation outlining what has transpired to date. He <br />stated that Council has until August 8, 2007 to take action on this request unless the applicant agrees to <br />an extension in writing. BESA's attorney, Bruce Malkerson, stated that his client would be willing to <br />sign an extension authorization. City Attorney Dave Snyder recommended tabling action on this matter <br />to incorporate language in the draft resolution that reflects state statute taking precedent over City code. <br />Miron made motion, Petryk seconded, to table action on this matter until the Council meeting of August <br />20, 2007 to allow the City Attorney to draft language in the proposed resolution subject to applicant <br />signing an application extension. <br />VOTING AYE: Granger, Petryk, Miron <br />ABSTAINED: Frank Puleo <br />Motion Carried. <br />HANSEN GRAVEL PIT NEIGHBORHOOD MEETING <br />At its June 18, 2007 meeting, Council listened to a presentation from CD Director Bryan Bear regarding <br />recent reclamation activities at the Hansen gravel pit. Council voted to schedule a neighborhood <br />meeting to discuss the final reclamation work. The meeting was held on Thursday, July 12 and was <br />attended by Mayor Miron and Council member Haas. CD Director Bryan Bear provided a PowerPoint <br />update of the meeting to Council and requested direction on remaining reclamation activities at the pit. <br />Miron made motion, Petryk seconded, directing the City Attorney to write a letter requesting the site to <br />be reclaimed in full compliance with the approved reclamation plan. <br />All aye. Motion Carried. <br />DISCUSSION ON PROCEDURE FOR VARIANCE REQUESTS <br />The Board of Zoning Appeals has requested the Council consider amendments to the process for <br />approving variances.
