City Council meeting of September 17, 2007 <br />Page 4 <br />DISCUSSION ON REVISIONS TO FLOODPLAIN ORDINANCE <br />In 2006, the City received notification from the MnDNR that the City's floodplain ordinance was not <br />consistent with the DNR's standards. CD Director Bryan Bear and Associate Planner Rachel Simone <br />met with DNR officials and over the past several months and have made several revisions to the <br />ordinance in order to bring it into conformance with DNR standards. Rachel provided Council with a <br />PowerPoint slide show of the revisions that have been made, as well as a recommendation for Council to <br />consider the adoption of the revised floodplain ordinance. <br />Haas made motion, Petryk seconded, directing staff to prepare a draft Floodplain Ordinance for Council <br />review prior to scheduling a Planning Commission public hearing. <br />All aye. Motion Carried. <br />DISCUSSION ON TRAFFIC CONTROLS AT TH61 AND CSAR 4 <br />At its September 4, 2007 meeting, Council discussed the traffic concerns related to the intersection of <br />TH61 and CSAH 4 and the concern over the accidents and that have taken place at the intersection. City <br />staff was directed to compile traffic data and provide that to Council. City Engineer Jay Kennedy shared <br />with Council and staff the Washington County data, as well as measures that could be taken to help <br />prevent future accidents. <br />Miron made motion, Haas seconded, to table discussion of this matter until Washington County officials <br />can be present at a City Council meeting to discuss this matter. <br />All aye. Motion Carried. <br />DISCUSSION ON PARK DEDICATION FEES AND NEW STATE LEGISLATION <br />In 2006, the Minnesota State Legislature made changes to state statute, which regulates how cities can <br />set park dedication fees. CD Director Bryan Bear shared with Council research compiled by staff to date <br />and City Attorney Dave Snyder felt that the current $2,400 per lot fee was justifiable. No formal City <br />Council action was taken. <br />2007 MINNESOTA STATE LEGISLATION "FREEDOM TO BREATHE ACT OF 2007" <br />The Minnesota State Legislature approved new legislation making it illegal for bars and restaurants to <br />allow patrons to smoke in their facilities; specifically, smoking must take place outside of the building in <br />an area designated as a smoking only patio or pavilion. City staff met recently with the manager of the <br />American Legion and owners of the Blacksmith Lounge to discuss this issue in order to share with them <br />the recommended modifications suggested by the MN State Legislature. CD Director Bryan Bear shared <br />with Council results of those discussions and the modifications being proposed by the manager of the <br />American Legion and owners of the Blacksmith Lounge. No formal City Council action was taken. <br />
