City Council meeting of April 4, 2005 <br />Page 4 <br />was informed that they must close the north end of the road and begin efforts to construct a hammer <br />head cul-de-sac. Since that time, Pulte requested that the road be allowed to remain open until July 1, <br />2005 in order to allow Pulte to complete construction of 149h Street prior to closing Everton Avenue. <br />City staff was contacted by property owners living on Everton Avenue, who had continued to have <br />discussions with Pulte Homes regarding the closing of the road. On March 15, 2005, Everton Avenue <br />neighbors met with City staff and Council member Frank Puleo, and Todd Baumgartner from Pulte <br />Homes, to discuss the issue. The road is a City street under the complete jurisdiction of the City <br />Council. Pulte has agreed to pave Everton Avenue as a rural section to its northern terminus. <br />Neighbors informed City officials that they are in support of Pulte's request and submitted a petition, <br />representing signatures from 100% of the property owners along Everton Avenue, in support of the <br />proposal. City staff reviewed the request and is supportive of Pulte's request to pave the road, as it will <br />eliminate an isolated segment of gravel roadway that the City would otherwise continue to maintain. <br />City Engineer Jay Kennedy stated that the entire roadway would remain under warranty until fall 2006. <br />Haas made motion, Puleo seconded, to approve a revised development agreement with Pulte Homes for <br />Waters Edge to allow the road to stay open as access for Pulte Homes' equipment and vehicular trucks <br />until July 1, 2005. <br />All aye. Motion Carried. <br />APPROVE REVISED DEVELOPMENT AGREEMENT FOR WATERS EDGE SOUTH 1s'r <br />ADDITION <br />Over the past two months, City staff, along with Council members Mike Granger and Frank Puleo, has <br />met with representatives of Pulte Homes, and finalized details related to the construction of <br />approximately % mile of Oneka Parkway. The development agreement for Waters Edge South 1 st <br />Addition has been revised to more formally describe the responsibilities of Pulte related to construction <br />of the Parkway. Under the proposed development agreement, Pulte will build the entire roadway, <br />including utilities, lighting and landscaping. The City will reimburse Pulte for the construction of <br />utilities within the road through development fees related to the Waters Edge development. The City <br />will also reimburse Pulte for the cost of installing the landscaping and lighting. The Waters Edge <br />Homeowners Association will maintain the landscaping within the Parkway. <br />Haas made motion, Granger seconded, to approve the revised development agreement for Waters Edge <br />South 1" Addition. <br />All aye. Motion Carried. <br />Pulte Homes requested approval of a final plat and development agreement for Waters Edge South <br />Second Addition for 213 townhome units on 71 acres located east of Everton Avenue, south of the <br />Waters Edge North development and north of CR8. CD Director Bryan Bear reviewed the <br />Puleo made motion, Haas seconded, to RESOLUTION 2005-16 APPROVING THE FINAL PLAT <br />
